A BILL

 

for

 

 1  AN ACT relating to public schools; requiring school
 2  districts to implement a reading assessment for first and
 3  second grade students; requiring demonstration of
 4  proficiency; requiring remediation programs; imposing
 5  duties on the state board of education; providing payments
 6  to districts from the foundation program account; providing
 7  an appropriation; specifying application; and providing for
 8  an effective date.

10  Be It Enacted by the Legislature of the State of Wyoming:

12         Section 1.  W.S. 21-3-301 is created to read:

17         21-3-301.  Reading assessment and intervention.

 2         (a)  Each school district shall design and implement a
 3  reading screening program that measures student reading
 4  progress in grades one (1) and two (2).  The screening
 5  program shall be designed by each school district in
 6  consultation with the state superintendent, aligned to the
 7  statewide educational program standards and shall
 8  specifically screen for student performance in reading at
 9  grades one (1) and two (2).

11         (b)  Students not screening successfully shall be
12  assessed to identify the specific reading problem and
13  determine its nature.  Students not showing appropriate
14  reading competence shall be placed on an individualized
15  reading plan (IRP) to remedy the reading related
16  difficulty.  The IRP shall be approved in writing by both
17  the parent or guardian and the district and shall utilize
18  an appropriate research based intervention program.  For
19  students under an individualized education program (IEP),
20  the IEP shall be deemed sufficient to meet the requirements
21  of this subsection and no additional plan shall be
22  required.

 1         (c)  The state board of education shall by rule and
 2  regulation, consistent with the intent of this section,
 3  provide for the screening of students entering grade two
 4  (2) or grade three (3) from private education, from a
 5  school outside of Wyoming and as necessary from another
 6  school district within Wyoming.  In addition, the board may
 7  delay the grade two (2) screening requirement imposed under
 8  this section by one (1) year to phase in implementation of
 9  screening requirements under this section.

11         Section 2.  W.S. 21-3-110(a) by creating a new
12  paragraph (xxii) is amended to read:

14         21-3-110.  Duties of boards of trustees.

15 

16         (a)  The board of trustees in each school district
17  shall:

18 

19              (xxii)  Implement and administer the reading
20  screening program for students in grades one (1) and two
21  (2) as required by W.S. 21-3-301.

 1         (a)  For school year 2001-2002, the state department
 2  shall pay from the foundation program account an amount to
 3  each district determined by multiplying one hundred
 4  sixty-seven dollars ($167.00) by the average daily
 5  membership (ADM) in kindergarten through grade two (2). 
 6  For purposes of this subsection and notwithstanding W.S.
 7  21-13-309(q), the average daily membership (ADM) for each
 8  district's kindergarten through grade two (2) students
 9  shall be computed based upon the prior year ADM.  In
10  addition and notwithstanding W.S. 21-13-309(s), the ADM for
11  each district's kindergarten students shall not be divided
12  by two (2).  Payments computed under this subsection shall
13  be used by districts to implement the screening assessment
14  and intervention required under section 1 of this act.

16         (b)  The payment computed pursuant to subsection (a)
17  of this section shall be made by the department on or about
18  October 15, 2001.

20         Section 4.  Two hundred thirty thousand dollars
21  ($230,000.00) is appropriated from the general fund to the
22  department of education for purposes of implementing this
23  act.

 1         Section 5.  No school district shall be required to
 2  comply with this act during the 2000-2001 school year. 
 3  Nothing in this act prohibits any school district from
 4  voluntarily implementing portions of this act during the
 5  2000-2001 school year.

 7         Section 6.  This act is effective July 1, 2001.
