A BILL

 

for

 

 1  AN ACT relating to litter; providing for notification to
 2  publisher to terminate delivery of written material;
 3  requiring publisher to maintain list of those terminating
 4  delivery of written material; requiring publisher to
 5  terminate delivery to those on list; providing penalties;
 6  and providing for an effective date.

 7 

 8  Be It Enacted by the Legislature of the State of Wyoming:

 9 

10         Section 1.  W.S. 6-3-204 by creating a new subsection
11  (c) and renumbering (c) as (d) is amended to read:

12 

13         6-3-204.  Littering; penalties.

14 

15         (c)  A publisher is guilty of littering under
16  subsection (a) of this section if the publisher or his
17  employee, agent or independent contractor delivers an

 1  unsolicited newspaper, free community paper or shopper,
 2  pamphlet, advertisement, or similar written material to a
 3  person's residence or place of business other than through
 4  the United States mail, regardless of where the material is
 5  placed on the property, after the person has requested, as
 6  provided in this subsection, that the material not be
 7  delivered to the person's residence or place of business. A
 8  person who wishes to terminate receipt of written material
 9  shall request in writing by certified mail, return receipt
10  requested, addressed to the publisher of the material that
11  delivery of the material be terminated. A publisher of
12  material specified in this subsection shall maintain a list
13  of those persons who have requested the termination of
14  delivery to them of the publisher's written material. The
15  publisher shall update the list continuously not later than
16  three (3) business days after receipt of a request.

18         (c)(d)  Littering is a misdemeanor punishable by
19  imprisonment for not more than six (6) months, a fine of
20  not more than seven hundred fifty dollars ($750.00), or
21  both. The court may suspend all or a part of a sentence
22  imposed under this section and require the person convicted
23  of littering to perform up to forty (40) hours of labor in

 1  the form of cleaning litter debris from public roads, parks
 2  or other public areas or facilities.

 3 

 4         Section 2.  This act is effective July 1, 2001.
