A BILL

 

for

 

 1  AN ACT relating to peace officers; clarifying the
 2  definition of livestock board investigators and brand
 3  inspectors as peace officers as specified; and providing
 4  for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 6-1-104(a)(vi)(F) and
 9  7-2-101(a)(iv)(E) are amended to read:

10 

11         6-1-104.  Definitions.

12 

13         (a)  As used in W.S. 6-1-101 through 6-10-203 unless
14  otherwise defined:

 1              (vi)  "Peace officer" includes the following
 2  officers assigned to duty in the state of Wyoming:

 3 

 4                   (F)  Investigators and brand inspectors of
 5  the Wyoming livestock board authorized under W.S. 11-20-201
 6  who have qualified pursuant to W.S. 9-1-701 through 9-1-707
 7  when:

 8 

 9                         (I)  Enforcing W.S. 11-19-101 through
10  11-24-115 and 11-29-101 through 11-30-113 and any laws
11  prohibiting theft or mutilation of livestock or any part
12  thereof the provisions of chapters 3 and 9 of title 6,
13  title 11, chapter 10 of title 35, any rule or regulation
14  promulgated by the Wyoming livestock board or any other law
15  for which they are granted enforcement authority;

16 

17                         (II)  Responding to a request to assist
18  another peace officer performing his official duty; or

19 

20                         (III)  Enforcing a valid arrest warrant
21  for any crime.

 1         (a)  As used in W.S. 7-2-101 through 7-2-105:

 2 

 3              (iv)  "Peace officer" means:

 4 

 5                   (E)  Investigators and brand inspectors of
 6  the Wyoming livestock board authorized under W.S. 11-18-101
 7  through 11-18-113 and 11-20-201 or duly authorized
 8  investigators of the Wyoming livestock board who have
 9  qualified pursuant to W.S. 9-1-701 through 9-1-707:

11                         (I)  When enforcing W.S. 11-19-101
12  through 11-24-115 and 11-29-101 through 11-30-113 and any
13  laws prohibiting theft, killing or mutilation of livestock
14  or any part thereof the provisions of chapters 3 and 9 of
15  title 6, title 11, chapter 10 of title 35, any rule or
16  regulation promulgated by the Wyoming livestock board or
17  any other law for which they are granted enforcement
18  authority;

19 

20                         (II)  When responding to a request to
21  assist another peace officer performing his official duty;
22  or

 1                         (III)  Enforcing a valid arrest warrant
 2  for any crime.

 3 

 4         Section 2.  This act is effective July 1, 2001.
