A BILL

 

for

 

 1  AN ACT relating to game and fish; authorizing use of owner
 2  identification numbers for licensed steel leg hold traps as
 3  specified; specifying that identification numbers are not
 4  public record; and providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 23-2-303(d) and (e) is amended to
 9  read:

10 

11         23-2-303.  Trapping licenses; tagging; steel leg hold
12  traps.

13 

14         (d)  All steel leg hold traps used for furbearing or
15  predatory animals shall have metal tags affixed thereto
16  bearing the name and address of the owner or the

 1  identification number assigned to the owner by the
 2  department. All steel leg hold traps shall be checked by
 3  the owner at least once during each seventy-two (72) hour
 4  period from the time the traps were set excluding traps set
 5  underwater. Violation of this subsection constitutes an
 6  eleventh degree misdemeanor.

 7 

 8         (e)  Any steel leg hold trap found in the field not
 9  bearing the name and address of the owner of the trap or
10  the identification number assigned to the trap owner by the
11  department shall be confiscated by any employee of the
12  department. Identification numbers affixed to a trap
13  pursuant to subsection (d) of this section are solely for
14  the use of the department or appropriate law enforcement
15  officers and are not a public record for purposes of W.S.
16  16-4-201 through 16-4-205.

18         Section 2.  This act is effective July 1, 2001.
