A BILL
for
1 AN ACT relating to the
game and fish commission; providing
2
definitions; amending the authority of the game and fish
3
commission as specified; requiring that the commission
4
control, propagate, manage, protect and regulate all
5
Wyoming wildlife as a public trust; and providing for an
6
effective date.

8 Be It Enacted by the Legislature of the State of Wyoming:
9
10 Section 1. W.S. 23-1-102(a)
by creating new
11 paragraphs (xvi) and (xvii) and 23-1-302(a)(xiv),
by
12 creating a new paragraph (xxix) and
by creating a new
13 subsection (m) are amended to read:

15 23-1-102. General definitions.

1 (a) As used in this act:
2
3 (xvi) "Public trust" means that wildlife is a
4 public
resource, held in trust by the state for the benefit
5 of all
present and future generations of Wyoming citizens;
6
7 (xvii) "Sustainable
use" means the control,
8 propagation, management, protection and regulation of all
9 Wyoming
wildlife by the state so that present and future
10 use and enjoyment by the public are
not compromised.

12 23-1-302. Powers and duties.

14 (a) The commission is directed and empowered:
15
16 (xiv) To
prescribe the requirements and form for
17 the licenses and tags provided for in this
act, to issue
18 licenses under the provisions of this act, including using
19 a competitive
random drawing when necessary to conserve and
20 manage wildlife
populations, to make regulations for the
21 sale and record of licenses and tags, and to
distribute
22 licenses and tags only to persons authorized
by the
23 commission to issue them;

1 (xxix) To control, propagate, manage, protect
2 and
regulate all Wyoming wildlife as a public trust, using
3 rules
and regulations that achieve the objective of
4 sustainable
use.

6 (m) The commission shall not:
7
8 (i) Take any action, either directly or
9 indirectly,
that conveys or may be construed to convey to
10 private persons any vested property interests in:
11
12 (A) Wildlife, prior to the lawful taking of
13 the wildlife; or
14
15 (B) Licenses to take wildlife.
16
17 (ii) Authorize or create, either directly or
18 indirectly, set-aside licenses, except as
authorized under
19 W.S. 23-1-302(h) or 23-1-705.

21 Section 2. This act is effective July 1, 2001.
