A BILL

 

for

 

 1  AN ACT relating to speed limits; reducing penalties for
 2  speed limit violations as specified; repealing conflicting
 3  provisions; and providing for an effective date.

 4 

 5  Be It Enacted by the Legislature of the State of Wyoming:

 6 

 7         Section 1.  W.S. 31-5-1201(d)(v) and by creating new
 8  paragraphs (vi) through (x) is amended to read:

 9 

10         31-5-1201.  Violation of provisions to constitute
11  misdemeanor; penalties.

13         (d)  Except as provided in subsection (g) of this
14  section:

 1              (v)  Notwithstanding W.S. 5-4-207 and 5-9-107 any
 2  other provision of law to the contrary, neither court costs
 3  nor the court automation fee for violations of W.S.
 4  31-5-301(b)(iii) or (iv) of a posted speed limit shall not
 5  be assessed for speeds up to four (4) miles per hour over
 6  the speed limits authorized by W.S. 31-5-301(b)(iii) or
 7  (iv);.

 8 

 9              (vi)  Every person convicted of a violation for
10  exceeding the posted speed limit by one (1) through five
11  (5) miles per hour over the posted speed limit shall be
12  fined fifteen dollars ($15.00);

13 

14              (vii)  Every person convicted of a violation for
15  exceeding the posted speed limit by six (6) through ten
16  (10) miles per hour over the posted speed limit shall be
17  fined twenty dollars ($20.00);

19              (viii)  Every person convicted of a violation for
20  exceeding the posted speed limit by eleven (11) through
21  fifteen (15) miles per hour over the posted speed limit
22  shall be fined twenty-five dollars ($25.00);

 1              (ix)  Every person convicted of a violation for
 2  exceeding the posted speed limit by more than fifteen (15)
 3  miles per hour over the posted speed limit shall be fined
 4  twenty-five dollars ($25.00) plus three dollars ($3.00) per
 5  mile for each mile in excess of fifteen (15) miles per hour
 6  over the posted speed limit;

 7 

 8              (x)  In addition to the fines under paragraphs
 9  (vi) through (x) of this subsection, every person convicted
10  of a violation of W.S. 31-5-301(b)(i) for exceeding the
11  posted speed limit in a school zone shall be fined
12  twenty-five dollars ($25.00).

14         Section 2.  W.S. 31-5-1201(d)(i) through (iii) is
15  repealed.

16 

17         Section 3.  This act is effective July 1, 2001.
