A BILL

 

for

 

 1  AN ACT relating to special permits and the sale of
 2  beverages by resort liquor license holders; authorizing
 3  resort liquor license holders to obtain catering permits
 4  under specified conditions; and providing for an effective
 5  date.

 6 

 7  Be It Enacted by the Legislature of the State of Wyoming:

 8 

 9         Section 1.  W.S. 12-4-404 and 12-4-502(b) are amended
10  to read:

12         12-4-404.  Sale of beverages for off-premises
13  consumption prohibited.

14 

15  Resort liquor licensees shall not sell alcoholic or malt
16  beverages for consumption off the premises owned or leased

 1  by the licensee, except pursuant to a catering permit. The
 2  dispensing of alcoholic or malt beverages licensed to be
 3  sold hereunder shall be controlled by W.S. 12-5-201 and if
 4  a catering permit has been issued by W.S. 12-4-502(b).

 6         12-4-502.  Twenty-four hour malt beverage permit and
 7  catering permit; restrictions; application procedure; fees.

 9         (b)  A catering permit authorizing the sale of
10  alcoholic and malt beverages may be issued by the
11  appropriate licensing authority to any person holding a
12  retail or resort retail liquor license authorizing the off-
13  premises sale of both alcoholic and malt beverages, for
14  sales at meetings, conventions, private parties and dinners
15  or at other similar gatherings not capable of being held
16  within the licensee's licensed premises. No licensee
17  holding a catering permit shall sell or permit consumption
18  of any alcoholic or malt beverage off the premises
19  described in the permit. Notwithstanding any other
20  provision of this subsection, closed-container items sold
21  at auction for the benefit of a nonprofit organization may
22  be taken off-premises.
