Speeding conviction records.

A BILL

 

for

 

 1  AN ACT relating to motor vehicles; modifying requirements
 2  with respect to reporting of convictions; and providing for
 3  an effective date.

 4 

 5  Be It Enacted by the Legislature of the State of Wyoming:

 6 

 7         Section 1.  W.S. 31-5-301(d) and 31-5-1201(d)(iv) are
 8  amended to read:

 9 

10         31-5-301.  Maximum speed limits.

11 

12         (d)  Speeding violations of up to eighty (80) miles
13  per hour under W.S. 31-5-301(b)(iii) or up to seventy (70)
14  miles per hour under W.S. 31-5-301(b)(iv) or up to ten (10)
15  miles per hour over the posted speed limit in all
16  instances, except violations for exceeding the speed limit

 1  in a school zone and violations received while operating a
 2  commercial motor vehicle as defined by W.S.
 3  31-7-102(a)(viii), shall not be made a part of the
 4  abstracts or records kept by the department of
 5  transportation pursuant to W.S. 31-5-1214 or 31-7-120.

 6 

 7         31-5-1201.  Violation of provisions to constitute
 8  misdemeanor; penalties.

 9 

10         (d)  Except as provided in subsection (g) of this
11  section:

12 

13              (iv)  Convictions shall not be considered
14  pursuant to W.S. 31-7-129(a)(i) for driver license
15  suspensions for speeding violations of less than eighty
16  (80) miles per hour where the speed limit is sixty-five
17  (65) through seventy-five (75) miles per hour or up to ten
18  (10) miles per hour over the posted speed limit in all
19  other instances, except speeding violations in school
20  zones;

22         Section 2.  This act is effective July 1, 2001.
