Civil penalty-electrical licensing provisions.

A BILL
for
1 AN ACT relating to
penalties for violations of electrical
2
licensing provisions; allowing the electrical board to
3 establish
a schedule of fines for violations of electrical
4
installation and licensing statutes; authorizing the board
5 to
act as the recommending agency to district attorneys or
6 the
attorney general for violations of electrical licensing
7 statutes; and providing for an effective date.

9 Be It Enacted by the Legislature of the State of Wyoming:
10
11 Section 1. W.S. 35-9-124 by
creating new subsections
12 (f) through (j) is amended to read:
13
14 35-9-124. Powers and duties of board; appeals.
15
16 (f) The board shall adopt a schedule of fines
17 pursuant
to subsection (g) of this section as penalties for

1 violating any provision of W.S. 35-9-120, 35-9-123,
2 35-9-125, 35-9-126 or 35-9-127. Such
fines shall be
3 assessed in conjunction with the
issuance of a citation,
4 pursuant to a stipulated settlement
agreement or following
5 an administrative hearing. The
schedule shall be adopted by
6 rule in accordance with the Wyoming
Administrative
7 Procedure Act.

9 (g) In developing the
schedule of fines, the board
10 shall:
11
12 (i) Provide that a first offense may carry a
13 fine
of up to one thousand dollars ($1,000.00);
14
15 (ii) Provide that a second or subsequent offense
16 may
carry a fine of up to two thousand dollars ($2,000.00);
17
18 (iii) Consider how the violation impacts the
19 public,
including any health and safety considerations;
20
21 (iv) Consider whether to provide for a range of
22 fines
for any particular violation or type of violation;
23 and

1 (vi) Provide uniformity in the fine schedule.

3 (h) Payment of all
fines and penalties imposed under
4 this section shall be made to the
county treasurer of the
5 county in which the violation occurs
to be credited to the
6 county school fund.

8 (j) The board shall
make recommendations to the
9 appropriate district attorney or
attorney general regarding
10 the
prosecution under W.S. 35-9-130 of any provision of
11 W.S.
35-9-120, 35-9-123, 35-9-125, 35-9-126 or 35-9-127.

13 Section 2. This act is effective July 1, 2001.
