Involuntary commitment costs.

A BILL
for
1 AN ACT relating to
emergency detentions and involuntary
2 commitments;
providing for liability for costs of emergency
3
detentions and involuntary commitments as specified;
4
providing an appropriation; and providing for an effective
5
date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section
1. W.S.
25-10-112(a)(intro), (i), (c)(intro)
10 and by creating a new subsection (e)
is amended to read:
11
12 25-10-112. Liability for costs of
detention,
13 involuntary hospitalization and proceedings therefor.
14
15 (a) Subject to
the provisions of subsection 16 subsections
(d) and (e) of this section, the county
in

which a person is detained or in which involuntary
2
hospitalization proceedings are brought shall pay the costs
3 of:
4
5 (i) The first seventy-two (72) hours of
6 detention, in addition to any Saturday, Sunday or legal
7 holiday that falls within the seventy-two
(72) hours,
8
pursuant to W.S. 25-10-109, including costs of medical
9
treatment for those conditions demanding immediate medical
10 attention;
11
12 (c) Subject to
the provisions of subsection 13 subsections
(d) and (e) of this section, if
involuntary
14 hospitalization is ordered pursuant to W.S.
25-10-110, the
15 county's liability for costs shall at that
time terminate.
16 The department shall not be responsible for
the costs of
17 treatment incurred after the entry of the
involuntary
18 hospitalization order unless the county
attorney notifies
19 the department of that order. Any costs of treatment
20 incurred after the involuntary
hospitalization order, all
21 costs of transportation and all involuntary
hospitalization
22 costs shall be paid by:

1 (e) When
a person is detained under W.S. 25-10-109 or
2 25-10-110, the county shall be liable
for costs of
3 treatment for the first seventy-two
(72) hours of
4 detention, in addition to any
Saturday, Sunday or legal
5 holiday that falls within the seventy-two
(72) hours, or
6 until a hearing required under W.S. 25-10-109(h)
or
7 25-10-110 is conducted. If the person
remains in detention
8 after the hearing pursuant to W.S. 25-10-109(k)(iii),
the
9 department shall directly, or under
contract with local
10 providers,
provide psychiatric treatment until the person
11 is
released from detention or involuntary commitment is
12 ordered.

14 Section 2. There
is appropriated from the general
15 fund five hundred forty thousand dollars
($540,000.00) to
16 the department of health, division of
behavioral health,
17 for the fiscal year beginning July 1, 2001
to provide
18 psychiatric assessments and treatment at
local facilities.

20 Section 3. This act is effective July 1, 2001.
