A BILL
for
1 AN ACT relating to
taxation and revenue; providing for the
2 payment
of property taxes under protest as specified; and
3
providing for an effective date.

5 Be It Enacted by the Legislature of the State of Wyoming:
6
7 Section 1. W.S. 39-13-109(f) is amended to read:
8
9 39-13-109. Taxpayer remedies.
10
11 (f) Escrow. If When taxes are paid under protest to
12 the extent of and due to an appeal pending
before the state
13 board of equalization or any court of
competent
14 jurisdiction, the county treasurer shall
deposit fifty
15 percent (50%) of
that protested amount under appeal in an
16 interest bearing escrow account and withhold
distribution

1 under
W.S. 39-13-111 until a final decision on the appeal
2 has
been rendered. Fifty percent (50%) of the amount of
3 taxes under protest shall be distributed as provided under
4 W.S. 39-13-111. To the extent the taxpayer
prevails in the
5 appeal,
the county treasurer shall refund that fifty
6 percent (50%) of the amount under appeal which was
7 deposited into an escrow account, plus interest
earned
8 thereon,
to the taxpayer within thirty (30) days from the
9 day
the final decision is rendered. The taxpayer shall
10 receive credit
for the remaining fifty percent (50%) of the
11 amount which was
distributed under W.S. 39-13-111 against
12 any future tax
liability under the provisions of this
13 chapter. If the taxpayer pays to the county an amount
in
14 excess of the protested amount under appeal,
the excess
15 shall be distributed as provided under W.S.
39-13-111. At
16 the time of
payment of taxes under protest, the taxpayer
17 shall disclose
that portion of taxes under protest to the
18 county treasurer.

20 Section 2. This act is effective July 1, 2001.
