A BILL

 

for

 

 1  AN ACT relating to peace officers; amending the definition
 2  of peace officer to include Bureau of Indian Affairs peace
 3  officers as specified; excluding such officers from waiver
 4  of governmental immunity under the Wyoming Governmental
 5  Claims Act; excluding coverage for such officers under the
 6  state self-insurance program; conforming related
 7  provisions; and providing for an effective date.

 9  Be It Enacted by the Legislature of the State of Wyoming:

10 

11         Section 1.  W.S. 1-39-103(a)(iii), 1-41-102(a)(iv),
12  6-1-104(a)(vi) by creating a new subparagraph (N) and
13  7-2-101(a)(iv) by creating a new subparagraph (M) are
14  amended to read:

 2         (a)  As used in this act:

 3 

 4              (iii)  "Peace officer" means as defined by W.S.
 5  7-2-101, but does not include those officers defined by
 6  W.S. 7-2-101(a)(iv)(K) or (M);

 8         1-41-102.  Definitions.

 9 

10         (a)  As used in this act:

11 

12              (iv)  "Peace officer" means as defined by W.S.
13  7-2-101, but does not include those officers defined by
14  W.S. 7-2-101(a)(iv)(K) or (M);

16         6-1-104.  Definitions.

18         (a)  As used in W.S. 6-1-101 through 6-10-203 unless
19  otherwise defined:

21              (vi)  "Peace officer" includes the following
22  officers assigned to duty in the state of Wyoming:

 1                   (N)  Any United States Bureau of Indian
 2  Affairs peace officer acting pursuant to 25 U.S.C. § 2803
 3  who has been appointed as a special deputy sheriff pursuant
 4  to W.S. 18-3-602(c) by the sheriff of Fremont or Hot
 5  Springs county.

 7         7-2-101.  Definitions.

 8 

 9         (a)  As used in W.S. 7-2-101 through 7-2-105:

11              (iv)  "Peace officer" means:

12 

13                   (M)  Any United States Bureau of Indian
14  Affairs peace officer acting pursuant to 25 U.S.C. § 2803
15  who has been appointed as a special deputy sheriff pursuant
16  to W.S. 18-3-602(c) by the sheriff of Fremont or Hot
17  Springs county.

19         Section 2.  This act is effective July 1, 2001.
