Child abuse-crimes in presence of child.

A BILL

for

 1  AN ACT relating to child abuse; prohibiting commission of
 2  specified acts of violence in the presence of a child;
 3  defining elements; imposing penalties; and providing for an
 4  effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 6-2-501 by creating a new subsection
 9  (g) and 6-2-503 by creating new subsections (c) and (d) are
10  amended to read:

11 

12         6-2-501.  Simple assault; battery; battery committed
13  in presence of child; penalties.

14 

15         (g)  A person who commits battery against any other
16  household member as defined by W.S. 35-21-102(a)(iv), in

 1  the presence of a child as defined by W.S. 6-2-503(d), is
 2  guilty of a misdemeanor punishable by imprisonment for not
 3  more than one (1) year, a penalty of not more than one
 4  thousand dollars ($1,000.00), or both.

 5 

 6         6-2-503.  Child abuse; commission of violent act in
 7  presence of child; penalty.

 8 

 9         (c)  In addition to subsection (b) of this section, a
10  person is guilty of child abuse, a felony punishable by
11  imprisonment for not more than three (3) years, if in the
12  presence of a child, he commits or attempts to commit:

13 

14              (i)  A violation of W.S. 6-2-101 or 6-2-104
15  through 6-2-108 against a household member as defined under
16  W.S. 35-21-102(a)(iv);

17 

18              (ii)  A violation of W.S. 6-2-502 against a
19  household member as defined under W.S. 35-21-102(a)(iv).

21         (d)  As used in subsection (c) of this section, "in
22  the presence of a child" means:

23 

24              (i)  The child is age one (1) or greater; and

 2              (ii)  In the actual physical presence of the child; or

 3 

 4              (iii)  Having knowledge that a child is present and
 5  that the child may see or hear an act of violence.

 6 

 7         Section 2.  This act is effective July 1, 2001.
