A BILL
for
1 AN ACT relating to the
state minimum wage rates; increasing
2 the
state minimum wage rate for tipped employees as
3
specified; and providing for an effective date.

5 Be It Enacted by the Legislature of the State of Wyoming:
6
7 Section 1. W.S. 27-4-202(b) is amended to read:
8
9 27-4-202. Minimum wage rates.
10
11 (b) For the purpose of this law, in determining the 12
wage
rate of a tipped employee, the amount paid such 13
employee
by his employer shall be deemed to be increased on 14
account
of tips received by an employee by an amount not in 15
excess
of fifty percent (50%) of the applicable minimum 16
wage.
Provided, however, in all cases the minimum wage paid

1 by an employer to his employee shall not be less than one 2
dollar and ten cents ($1.10) per hour
effective June 1, 3
1971 and thereafter. Effective April 1, 2001 and
4 thereafter, all employers who employ
tipped employees shall
5 not pay less than four dollars ($4.00)
per hour to his
6 tipped employees. For the
purposes of this act, all "tip"
7 employees
shall furnish monthly to their respective
8
employers the daily record of tips required to be kept by
9
"tip" employees under the laws of the United States and
10 upon the forms prescribed by the internal
revenue service
11 of the United States treasury department. Said The
daily
12 record of tips shall constitute prima facie
proof of the
13 amount of tips received by such an the
employee. Proof of a
14 customary tipping percentage of sales or
service shall also
15 be an admissible form of proof of the amount
of tips. A
16 "tip" employee is one who
customarily and regularly
17 receives more than twenty dollars ($20.00) a
month in tips.

19 Section 2. This act is effective April 1, 2001.
