Real estate subdivision requirements.

A BILL
for
1 AN ACT relating to real
estate; amending definition of
2
subdivision; modifying exemptions from subdivision
3 requirements;
and providing for an effective date.

5 Be It Enacted by the Legislature of the State of Wyoming:
6
7 Section
1. W.S.
18-5-302(a)(vii), 18-5-303(a) by
8
creating new paragraphs (ix) through (xii) and by creating
9
a new subsection (b) are amended to read:
10
11 18-5-302. Definitions.
12
13 (a) As used in this article:
14
15 (vii) "Subdivision"
means a the
creation or
16 division of a lot, tract, parcel or other
unit of land into 17
three (3) or
more lots, plots, units, sites or other

1 subdivisions of land for the immediate or future
purpose of
2 sale,
building development or redevelopment, for
3 residential,
recreational, industrial, commercial or public
4
uses. The word "subdivide" or any derivative thereof shall
5
have reference to the term subdivision, including mobile
6
home courts, the creation of which constitutes a
7
subdivision of land;
8
9 18-5-303. Exemptions from provisions.
10
11 (a) Unless the
method of sale is adopted for the
12 purpose of evading the provisions of this
article, this
13 article shall not apply to:
14
15 (ix) A division of a lot, tract, parcel or other
16 unit
of land for the purpose of sale or gift to a member of
17 the
immediate family of the property owner. For purposes of
18 this
paragraph, a "member of the immediate family" means
19 any
person who is a natural or legally defined offspring,
20 spouse,
sibling, grandchild, grandparent or parent of the
21 owner;

23 (x) A one (1) time division of land less than
24 thirty-five
(35) acres;

2 (xi) If the creation or
division occurs through
3 the action of a government entity or
by eminent domain it
4 shall not be considered a subdivision
under this article;
5
6 (xii) Mortgages, deeds
of trust and other
7 security instruments, easements,
rights of way, judgments,
8 decrees and sheriff's deeds resulting
from a judicial
9 action or foreclosure.
10
11 (b) This article shall not apply to the sale or
12 division
of land where the parcels involved in the sale or
13 division
are thirty-five (35) acres or larger.
14
15 Section 2. W.S. 18-5-310 is repealed.
16
17 Section 3. This act is effective July 1, 2001.
