Low income energy assistance program.

A BILL

 

for

 

 1  AN ACT relating to low income energy assistance;
 2  authorizing the department of family services to administer
 3  the low income energy assistance program as specified;
 4  establishing eligibility criteria; and providing for an
 5  effective date.

 6 

 7  Be It Enacted by the Legislature of the State of Wyoming:

 8 

 9         Section 1.  W.S. 42-2-115 is created to read:

10 

11         42-2-115.  Low income energy assistance program;
12  eligibility.

13 

14         (a)  There is created a state low income energy
15  assistance program. The department shall:

 1              (i)  Provide assistance to eligible recipients by
 2  paying a portion of the recipient family's home energy
 3  costs directly to the supplier;

 4 

 5              (ii)  Administer the low income energy assistance
 6  program, using federal funds allocated to the state and
 7  funds appropriated by the legislature for the program.

 8 

 9         (b)  Applicants with a gross family income of not more
10  than one hundred eighty-five percent (185%) of the federal
11  poverty level shall be eligible for the program created
12  under this section. Any credit, rebate or refund of a sales
13  or use tax on home energy products received by an applicant
14  shall not be calculated in determining the applicant's
15  gross family income under this section. Applicants shall
16  apply for benefits under the program with the nearest field
17  office of the department.

19         Section 2.  This act is effective immediately upon
20  completion of all acts necessary for a bill to become law
21  as provided by Article 4, Section 8 of the Wyoming
22  Constitution.
