School capital construction select committee.

A BILL
for
1 AN ACT relating to
school capital construction;
2
establishing a select committee on capital construction as
3
specified; prescribing duties; requiring a report;
4
providing an appropriation; and providing for an effective
5
date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8

11 (a) There is
created the select committee on school
12 capital construction consisting of the
following members:
13
14 (i) Five (5)
members of the Wyoming senate
15 appointed by the president of the senate
subject to the
16 following:

2 (A) Not more
than two (2) of whom shall be
3
members of the senate education committee;
4
5 (B) Not more
than two (2) of whom shall be
6 members
of the senate appropriations committee; and
7
8 (C) Not more
than three (3) of whom shall
9 be
from the same political party.

11 (ii) Five (5)
members of the Wyoming house of
12 representatives appointed by the speaker of
the house of
13 representatives subject to the following:
14
15 (A) Not more
than two (2) of whom shall be
16 members of the house education committee;
17
18 (B) Not more
than two (2) of whom shall be
19 members of the house appropriations
committee; and
20
21 (C) Not more
than three (3) of whom shall
22 be from the same political party.

1 (b) The
president of the senate and the speaker of
2 the
house of representatives shall each appoint a
3
cochairman of the select committee. The committee may
4
contract with consultants as necessary. Staff services to
5 the
committee shall be provided by the legislative service
6
office.

8 (c) The select
committee shall review the school
9 capital
construction program established under W.S.
10 21-15-105 through 21-15-112 and make
recommendations to the
11 legislature on a revised program which may
include:
12
13 (i) A three (3)
phase process for consideration
14 of individual school district capital
construction projects
15 that both address identified school building
and facility
16 needs and require state assistance to
complete required
17 construction, where:
18
19 (A) Phase one
(1) consists of a review of
20 the building or facility need as identified
by the
21 statewide needs assessment pursuant to W.S.
21-15-107(b),
22 and the relationship of the proposed method
to address the
23 building need to the scores contained within
the needs
24 assessment;

2 (B) Phase two
(2) consists of the

development of planning and other schematic design
4
documents and an independent professional review and
5
analysis of the plans and documents, with recommendations
6
available for purposes of subparagraph (i)(C) of this
7
subsection;

9 (C) Phase three
(3) consists of legislative
10 review of findings and recommendations
developed under
11 subparagraph (i)(B) of the subsection and
the development
12 of project funding, including future monitoring
and
13 reporting of project development.

15 (ii) A process
for the provision of emergency
16 assistance for district's experiencing bona
fide emergency
17 building and facility needs, subject to
legislative review;
18
19 (iii) Funding for
school capital construction
20 needs.

22 (d) In addition
to subsection (c) of this section,
23 the select committee shall address any
matter resulting
24 from court decisions with respect to
currently pending

cases regarding school capital construction which requires
2
legislative action.

4 (e) The select
committee shall report to the
5
legislature not later than February 1, 2002, on
6
recommendations developed under subsections (c) and (d) of
7
this section, together with necessary legislation
8
implementing committee recommendations. The select
9
committee may introduce legislation as other committees of
10 the legislature.

12 (f) Fifty
thousand dollars ($50,000.00) is
13 appropriated from the general fund to the
legislative
14 service office to implement this act.
Expenditures shall be
15 made only with the approval of the select
committee.

17 Section
2. This act is effective
immediately upon
18 completion of all acts necessary for a bill
to become law
19 as provided by Article 4, Section 8 of the
Wyoming
20 Constitution.
