A BILL
for
1 AN ACT relating to peace
officers; providing for the
2
issuance of an identification card to retired peace
3
officers; providing for cancellation of the card; providing
4
penalties; and providing for an effective date.
5
6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section 1. W.S. 9-1-709 is created to read:
9
10 9-1-709. Peace officers; retirement credentials.
11
12 (a) The
director of the peace officer standards and
13 training commission shall authorize the issuance
of a
14 retirement identification card to a retired
peace officer
15 upon receipt of an application meeting the
requirements of

subsection (b) of this section and payment of the required
2
fee.

4 (b) The
application for an identification card under
5
this section shall be signed and verified by the applicant
6 and
shall include:
7
8 (i) The
applicant's name and any other
9
identifying information the commission may require;
10
11 (ii) Written
verification from the employing
12 agency, in a form satisfactory to the
director, that the
13 applicant prior to his retirement was
employed by a law
14 enforcement unit in this state and was
certified as a peace
15 officer in good standing under this act.
16
17 (c) At the
request of the director of the peace
18 officer standards and training commission,
the department
19 of transportation shall prepare and issue an
identification
20 card under this section which shall contain:
21
22 (i) A
distinguishing number assigned to the
23 applicant;

1 (ii) The
applicant's full legal name and
2
resident address;
3
4 (iii) A brief
description of the applicant
5
including sex, height and weight;
6
7 (iv) The applicant's picture;
8
9 (v) Information
identifying the applicant as a
10 retired peace officer of the state of
Wyoming including the
11 name of the law enforcement unit employing
the applicant
12 and the highest rank held by the applicant
prior to his
13 retirement.
14
15 (d) Identification
cards issued under this section
16 shall not expire. The commission shall keep
records of data
17 contained in identification cards and may
confirm the
18 authenticity of the card to any person.
19
20 (e) Upon
submission by the applicant of a verified
21 statement to the peace officers standards
and training
22 commission that an identification card
issued under this
23 section has been lost, destroyed or
mutilated, the person
24 to whom it was issued may obtain a new
identification card

upon furnishing the same documentary evidence required for
2
issuance of an original identification card and paying the
3 fee
required by subsection (f) of this section.

5 (f) Each
applicant for an identification card under
6
this section shall pay to the commission a fee of ten
7
dollars ($10.00) which shall be credited to the highway
8
fund.
9
10 (g) The peace
officer standards and training
11 commission shall revoke and cancel an
identification card
12 issued under this section upon determining
that the card
13 holder has entered a plea of guilty or nolo
contendere to
14 or has been convicted of:
15
16 (i) Any felony; or
17
18 (ii) A violation
of W.S. 6-4-404, 6-2-501(a),
19 (b), (e) or (f)(i) or 6-2-504(a) or (b) if
the defendant
20 and the victim are household members as
defined by W.S.
21 35-21-102(a)(iv).

23 (h) No person shall:

1 (i) Possess any
cancelled, fictitious,
2
fraudulently altered or fraudulently obtained
3
identification card issued under this section;
4
5 (ii) Lend his
identification card to any other
6
person or knowingly permit its use by another;
7
8 (iii) Display or
represent any identification
9
card not issued to him as being his card;
10
11 (iv) Photograph,
photostat, duplicate or in any
12 way reproduce any identification card or
facsimile thereof
13 in such a manner that it could be mistaken
for a valid
14 identification card issued under this
section;
15
16 (v) Procure an
identification card under this
17 section by false swearing, fraud or false
statement of any
18 kind or in any form.
19
20 (j) Any person
who violates any provision of
21 subsection (h) of this section is guilty of
a misdemeanor
22 punishable by a fine of not more than seven
hundred fifty
23 dollars ($750.00), by imprisonment for not
more than ninety
24 (90) days, or both.

2 Section 2. W.S. 9-1-701(a)(xii) is amended to read:

4 9-1-701. Definitions.
5
6 (a) As used in this act:
7
8 (xii) "This
act" means W.S. 9-1-701 through
9 9-1-708 9-1-709;
10
11 Section 3. This act is effective July 1, 2001.
