Water & sewer district board-compensation.

A BILL
for
1 AN ACT relating to
water; increasing the compensation for
2
members of a water and sewer district board; and providing
3 for
an effective date.

5 Be It Enacted by the Legislature of the State of Wyoming:
6
7 Section 1. W.S. 41-10-110(f) is amended to read:
8
9 41-10-110. Original board generally.
10
11 (f) Each member
of the board shall receive as
12 compensation for his service a sum fixed by
the board not
13 in excess of ten
dollars ($10.00) twenty-five dollars
14 ($25.00)
for actual attendance at each regular or special
15 meeting of the board or attendance upon any
committee
16 meeting, payable monthly. No member of the
board shall
17 receive any compensation as an employee of
the district

whenever the board has determined that a manager should be
2
obtained and has employed such manager as a full-time
3
employee to manage the affairs of and operate the business
4 of
the district, but until the services of a full-time
5
manager are required and obtained, any board member may be
6
engaged from time to time or as a part-time employee, and
7 the
compensation paid therefor shall not exceed the
8
established prevailing rate of pay for equivalent work. No
9
member of the board shall be interested in any other
10 contract or transaction with the district
except in his
11 official representative capacity, and except
it be by
12 competitive bidding. If any contract or
agreement shall be
13 made in violation of the provisions of this
subsection it
14 shall be voidable, and no action shall be
maintained
15 thereon by any party thereto against the
district. To the
16 extent the district makes any payment
thereunder, such
17 contract or agreement shall be valid, and
any such payments
18 may be included in any cost defrayed by the
levy of special
19 assessments, unless theretofore, the
district elects to
20 void the contract or agreement in its
entirety and to
21 recover any such payment from the party to
whom made.
