Telecommunications-local exchange certificates.

 1  AN ACT relating to telecommunications; modifying provisions
 2  for granting concurrent certificates of public convenience
 3  and necessity in specified exchanges; and providing for an
 4  effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 37-15-201(c)(intro) is amended to
 9  read:

10 

11         37-15-201.  Regulation of local exchange services;
12  certificates of public convenience and necessity;
13  concurrent certificates.

14 

15         (c)  Prior to January 1, 2005, in the service
16  territory of a local exchange telecommunications company
17  with thirty thousand (30,000) or fewer access lines in the

 1  state, the commission shall, after notice and opportunity
 2  for a hearing, issue a concurrent certificate or
 3  certificates of public convenience and necessity to provide
 4  local exchange service,
only if the application clearly
 5  shows the applicant is willing and able to provide safe,
 6  adequate and reliable local exchange service to all persons
 7  within the entire existing local exchange area for which
 8  the certification is sought meets the requirements of
 9  subsection (b) of this section and the incumbent local
10  exchange service provider: commission finds that granting
11  the certificate is in the public interest. In determining
12  the public interest the commission shall consider the goals
13  of W.S. 37-15-102 and the intent of the applicant to serve
14  the entire area, may impose competitively neutral
15  requirements as authorized by 47 U.S.C. § 253(b) and may
16  require that the applicant be designated an eligible
17  communications carrier as provided under 47 U.S.C. §
18  253(f).  The provisions of this subsection shall not be
19  applied to refuse a concurrent certificate in the
20  certificated area of an incumbent provider that has
21  requested and received a concurrent certificate to provide
22  competitive local exchange services in another certificated
23  area of the state.

 1         Section 2.  W.S. 37-15-201(c)(i) through (v) is
 2  repealed.

 3 

 4         Section 3.  This act is effective immediately upon
 5  completion of all acts necessary for a bill to become law
 6  as provided by Article 4, Section 8 of the Wyoming
 7  Constitution.
