SENATE JOINT RESOLUTION NO.  SJ0005

 

 

Initiative and referendum signatures.

A BILL

 

for

 

 1  A JOINT RESOLUTION relating to initiative and referendum
 2  petitions; eliminating the requirement for signatures from
 3  all counties in the state.

 4 

 5  BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF WYOMING,
 6 
two-thirds of all the members of the two houses, voting
 7  separately, concurring therein:

 8 

 9         Section 1.  The following proposal to amend Wyoming
10  Constitution, Article 3, Section 52(c) is proposed for
11  submission to the electors of the State of Wyoming at the
12  next general election for approval or rejection to become
13  valid as a part of the Constitution if ratified by a
14  majority of the electors at the election:

16         Article 3, Section 52.  Initiative and referendum.

 1         (c)  After certification of the application, a
 2  petition containing a summary of the subject matter shall
 3  be prepared by the secretary of state for circulation by
 4  the sponsors.  The petition may be filed with the secretary
 5  of state if it
meets both of the following requirements:

 6 

 7              (i)  It is signed by qualified voters, equal in
 8  number to fifteen percent (15%) of those who voted in the
 9  preceding general election
.; and

10 

11              (ii)  It is signed by qualified voters equal in
12  number to fifteen percent (15%) of those resident in at
13  least two-thirds (2/3) of the counties of the state, as
14  determined by those who voted in the preceding general
15  election in that county.

17         Section 2.  The Secretary of State shall endorse the
18  following statement on the proposed amendment:

 1         The passage of this amendment would change the minimum
 2  requirements for petition signatures for initiative and
 3  referendums.  Currently the petitions must be signed by at
 4  least fifteen percent (15%) of the qualified voters in the
 5  state, with at least fifteen percent (15%) of the qualified
 6  voters of each county signing.  This amendment would keep
 7  the statewide requirement the same but would eliminate the
 8  requirement that the signatures be from fifteen percent
 9  (15%) of the qualified voters of each county.
