 (a)  The legislature finds that it is necessary that all senators be elected at the 2002 general election and that the classes of senators be balanced. To accomplish this:

(i)  Changes in all senate districts and in the number of senators in those districts are effective for the 2002 general election and the fifty-seventh legislature;

(ii)  All senators for the fifty-seventh legislature shall be elected at the 2002 general election;

(iii)  The senate districts are divided into two (2) classes consisting of all even‑numbered districts and all odd‑numbered districts. After the effective date of this act, but not later than April 1, 2002, the secretary of state shall randomly select one (1) of the two (2) classes of senate districts whose members shall be elected for a term of four (4) years at the 2002 general election. The members of the other class shall be elected for a term of two (2) years at the 2002 general election. Thereafter, all senators shall be elected for a term of four (4) years.

(b)  Nothing in this act otherwise affects the terms of members of the fifty-sixth legislature.".

(d)  Nothing in this act otherwise affects the terms of members of the fifty-sixth legislature.".

      ”Section 3.  Legislative findings and declaration.

      (a)  The legislature finds that under the redistricting plan adopted by this act:

(i)  In determining whether it is necessary to hold an election for a senate district whose geographic boundaries have changed under this act, relevant changes to be considered are those which have resulted in populated geographic areas being added to the district which were not part of the district at the last general election and which boundary changes thereby add new population to the district who did not have opportunity to participate in the election of the incumbent senate member currently representing that district;

            (ii) In four (4) of the senate districts, no new populated geographic areas were added to the district.  An additional twelve (12) senate districts have been changed to add new populated geographic areas resulting in an increase of new population to the district of less than four percent (4%) and in six (6) of those twelve (12) districts the increase has been less than one percent (1%).  The legislature therefore finds the population change in sixteen of the thirty senate districts to be de minimus;

            (iii) An additional eight (8) senate districts have been changed to add new populated geographic areas resulting in an increase of new population to the district of only ten percent (10%) or less. Of these eight (8) districts, five (5) are designated as odd-numbered districts under this act and are already scheduled for election of a member in the 2002 election;

            (iv)  Of the remaining six (6) districts:

(A)  Two (2) are designated as odd-numbered districts under this act and are already scheduled for election of a member in the 2002 election;

                  (B)  Of the remaining four (4) districts, the district experiencing the greatest increase of new population as a result of populated areas being added to the district under this act is already scheduled for election of a member in the 2002 election under W.S. 28-2-117(c);

                  (C)  In each of the other three (3) remaining districts, at least sixty-three percent (63%) of the population area remains unchanged from the district boundaries as they existed when the incumbent senate member was elected at the 2000 general election. Further, the terms of the three (3) members elected from these districts will end in 2004; and

            (v)  No member will continue to serve the remainder of his term if, following adoption of this act, his residence is no longer within geographic boundaries of the district in which he was elected.

      (b)  The legislature further finds and declares:

(i)  That any temporary dilution of voting power resulting from the holdover of members elected in the 2000 general election is de minimus and does not unduly burden a particular class or group; and

(ii)  That stability and continuity of membership in the senate constitute important state interests and are reasonably promoted by continuing the staggered terms for members in effect prior to the adoption of this act.".  HANES, MOCKLER, KINNISON
