Fifty thousand dollars ($50,000.00) of the amounts appropriated under this footnote shall be used to fund this review by the committee.  Committee review shall be limited to the efficiency and effectiveness of the remedies established by the district but shall not modify remedies proposed by the district.

(i)  Be administered by the state superintendent through the department of education;

(iii)  Be comprised of two hundred (200) public school students enrolled in grade six (6) during the 2001-2002 school year. The students shall be selected by the state superintendent from applicants without regard to school district, community or county of residence.

(b)  The two hundred (200) students selected pursuant to subsection (a) of this section shall be randomly divided into two (2) groups of one hundred (100) subject to the following:

(i)  One (1) group of one hundred (100) students shall be enrolled in a nonpublic school beginning with grade seven (7) and ending with completion of grade eight (8) and shall receive an annual payment of up to three thousand five hundred dollars ($3,500.00) during the two (2) year pilot program, which shall be used to pay tuition costs assessed by the school in which the student is enrolled. The department shall enter into agreements with the parent or guardian of selected students to ensure funding is used exclusively for tuition. Funding for the payments under these agreements shall be from that portion of the school foundation program account funded by the general fund. Any student within this group shall not be counted within the average daily membership (ADM) as computed for the purpose of implementing W.S. 21‑13‑309. Home-based educational programs as defined under W.S. 21‑4‑101(a)(v) are not eligible under this paragraph;

(ii)  The second group of one hundred (100) students shall serve as a control group only and shall be counted within the ADM of the school district in which the student resides and attends school. The second group shall also commence enrollment with grade seven (7) and end with completion of grade eight (8).

(c)  The state superintendent shall maintain a record of the results of the statewide assessment in reading, writing and mathematics administered pursuant to law to the two hundred (200) selected students when enrolled in grade eight (8) during school year 2003-2004, comparing student performance of the two (2) groups of one hundred (100) as established under subsection (b) of this section. Information developed under this subsection shall be used as a basis on which to make recommendations to the legislature under subsection (d) of this section only.

(d)  On or before June 30, 2004, the state superintendent shall report to the legislature on findings under this section with respect to the pilot program and provide recommendations on the future of voucher system in Wyoming education.".

(ii)  No revenue bonds shall be issued unless and until at least a total of three million dollars ($3,000,000.00) in cash or binding commitments has been received by the university or the city of Laramie to match the appropriation;

(iii)  The determination as to whether a binding commitment has been received shall be made by the attorney general;

(iv)  Cash or binding commitments shall be received not later than April 1, 2003, to be counted as matching funds under this section.

(c)  Not later than November 1, 2002, the university shall submit a report to the governor and the joint minerals, business and economic development interim committee regarding progress made toward securing matching funds. The report shall contain plans and recommendations for funding operations of the center."

(c)  Upon receipt of documents, plans and other information provided by the district under subsection (b) of this footnote, the joint appropriations committee or its legislative committee designee shall undertake an independent project value engineering analysis, an energy efficiency analysis and a safety and security review for the projects identified under subsection (a) of this footnote, to be completed by November 1, 2002. One hundred thousand dollars ($100,000.00) of the amounts appropriated under subsection (a) of this footnote shall be used to fund this review by the committee or its legislative committee designee. The committee or its legislative committee designee shall submit its recommendations to the governor by December 31, 2002. The governor shall approve or deny the recommendation by January 31, 2003.

(d)  Sheridan county school district no. 2 shall not sell land on which the central middle school is situated unless the amount of the sale is equal to or greater than the costs incurred for demolition and asbestos removal under paragraph (a)(v) of this footnote.  Amounts received from any sale under this subsection shall be paid to the state department of education for deposit in the school capital construction account.

(e)  Subsection (b) of this footnote is effective immediately.".

21-13-309.  Determination of amount to be included in foundation program for each district.

(o)  The revised model amount per ADM for each district computed under subsection (n) of this section shall be further adjusted for the following. Unless otherwise specified in this subsection, the adjustments under this subsection shall be determined as specified in the cost of education study, dated April 1997, and the spreadsheet provided by the consultant performing the study related thereto, both of which are on file in the legislative service office:

(i)  The amount shall be adjusted to provide for the effects of inflation for the 2001-2002 school year by increasing the amount computed under subsection (n) of this section by nine and forty-four hundredths percent (9.44%), and for the school year 2002‑2003, by increasing the amount computed under subsection (n) of this section by thirteen and twenty‑eight hundredths percent (13.28%);

2.             (a)  Of this general fund appropriation, one million ninety thousand dollars ($1,090,000.00) shall be expended only if 2002 Senate File 51 is not enacted into law by the legislature for the following studies:

(i)  Five hundred thousand dollars ($500,000.00) is available for expenditure by the state superintendent of public instruction for a vocational education study subject to the following:

(A)  The state superintendent of public instruction shall, in consultation with the state board of education, develop statewide minimum program criteria and guidelines prescribing qualification for public school vocational education programs for purposes of state funding under the education resource block grant model. The criteria and guidelines shall describe programs constituting vocational education in sufficient detail to determine educational programs and courses qualifying as vocational education content. As part of this study, the state superintendent shall review program delivery and structure to the extent necessary to identify and prescribe criteria and mechanisms for the most cost-effective use of resources in the provision of vocational education programs within schools, districts and the state.

(B)  In addition to subparagraph (a)(i)(A) of this footnote, the state superintendent of public instruction shall develop a vocational education cost data collection instrument and shall subsequently collect data from school districts on student participation in vocational education programs and on district expenditures for vocational education programs, specifically on expenditures for vocational education program instruction.  The collected data shall be of sufficient detail to enable the development of a mechanism within the education resource block grant model that would provide for the distribution of vocational education resources based upon the number of students participating in vocational education programs which meet or comply with state criteria and guidelines established under subparagraph (a)(i)(A) of this footnote.

(C)  Information, findings and recommendations developed under subparagraphs (a)(i)(A) and (B) of this footnote shall be reported by the state superintendent to the joint education interim committee on or before November 1, 2002. Information collected and other analytical material created for purposes of subparagraphs (a)(i)(A) and (B) of this footnote shall be filed with the legislative service office. The state superintendent may contract with appropriate experts and professionals as necessary to carry out subparagraphs (a)(i)(A) and (B) of this footnote.

(ii)  Twenty thousand dollars ($20,000.00) is available to the legislative service office for a vocational education funding adjustment study by the joint education interim committee.  Based upon information collected by the state superintendent under paragraph (a)(i) of this footnote, and in conjunction with study and data collection efforts of the state superintendent, the committee shall conduct a study to establish an adjustment to the education resource block grant model for vocational education.  Study findings and recommendations together with necessary enabling legislation, shall be completed in sufficient time to enable consideration by the Wyoming legislature in the 2003 general session.

(iii)  Twenty thousand dollars ($20,000.00) is available to the legislative service office for a study by the joint education interim committee of the readying assessment and intervention program established under W.S. 21‑3‑301.  The committee shall, through qualified contract assistance, establish a cost-based method of funding the program through the education resource block grant model, subject to remediation and reporting requirements established by W.S. 21‑3‑301. The study shall be conducted and structured to enable development of enabling legislation for consideration by the Wyoming legislature in the 2003 general session.

(iv)  Two hundred seventy thousand dollars ($270,000.00) is available to the legislative service office for a comprehensive review by the joint education interim committee of school district expenditures for special education programs and services, as defined by W.S. 21‑13‑321(a)(ii). The study shall be undertaken in conjunction with the state department of education and shall be used as a basis for establishing a cost-based method of funding special education programs and services, which would provide incentives to school districts to provide cost effective programs and services.  The study shall be completed in sufficient time to enable development of recommendations and necessary enabling legislation for consideration by the Wyoming legislature in the 2003 general session.

(v)  One hundred thousand dollars ($100,000.00) is available for the following small school study as follows:

(A)  The state superintendent shall develop necessary information and procedures for the establishment and application of criteria for defining small schools for purposes of the small school adjustment prescribed by law under W.S. 21‑13‑318 and 21‑13‑319. The state superintendent shall give consideration to recommendations provided by the consultant performing the January 2002 cost of education studies pertaining to small schools, specifically the recommendation for basing a definition upon buildings and facilities comprising a school. The state superintendent shall assemble a report on information and findings developed under this section and on or before November 1, 2002, submit the report together with recommendations to the joint education interim committee.

(B)  Based upon information and recommendations reported by the state superintendent under subsection (a) this section, the joint education interim committee shall submit recommendations together with necessary enabling legislation to the Wyoming legislature for consideration in the 2003 general session.

(C)  The state superintendent shall include in the study of the necessary small school adjustment conducted in accordance with subparagraph (a)(i)(A) of this footnote, further analysis and review of the components comprising the small school adjustment.  The analysis and review shall include consideration of the ability of the adjustment components to provide students attending Wyoming public schools with the educational program required by law.  Economy-of-scale issues and funding implications related to the analysis and review undertaken under this subsection shall involve Wyoming school districts and their data.

(vi)  One hundred thousand dollars ($100,000.00) shall be available to the legislative service office for a study of certified staff and related issues and at-risk study by the joint education interim committee.  The committee shall report study results, together with necessary implementing legislation, to the Wyoming legislature for consideration in the 2003 general session.  The study shall include the following:

(A)  The certified staff component within the education resource block grant model, including competitive salary levels, fringe benefits, health insurance, seniority and the education adjustment, and issues related thereto; and

(B)  The definition of at-risk students and for the at-risk students, the funding component within the education resource block grant model.

(vii)  Thirty thousand dollars ($30,000.00) is available to the division of economic analysis, department of administration and information for a study for the development of an instrument capable of measuring differences in regional costs for purposes of the education resource block grant model. The recommended instrument shall replace the Wyoming cost-of-living index as a measure of regional cost differences in computing the adjustment under W.S. 21‑13‑309(o)(ii). The department through the division may contract with appropriate expertise and professionals as necessary to develop the instrument. Information, methodology documentation and all other analytical material created for purposes of this subsection shall be filed with the legislative service office.  The division shall report recommendations developed under this paragraph to the joint education interim committee not later than November 1, 2002.  The joint education interim committee shall, following receipt of this information and recommendations reported by the division, review the report and forward any recommendations, together with any necessary enabling legislation, to the Wyoming legislature for consideration in the 2003 general session.

(viii)  Fifty thousand dollars ($50,000.00) is available to the legislative service office for the provision of a forum for facilitated discussions of data requirements, data composition, data quality and data quantity issues pertaining to the operation of the education resource block grant model, model prototypes contained within the model and the adjustments to the model prototypes.  The forum shall be facilitated by group facilitation professionals who shall assemble appropriate expertise in school finance data issues, including representatives of school districts, both large and small, urban and rural, and representatives of the division of economic analysis of the department of administration and information, state department of education, the department of audit, the department of employment and consultants to the legislature performing the cost of education studies.  The facilitator shall provide a report on the forum to the joint education interim committee on or before June 15, 2002.

(b)  Amounts available to the legislative service office under this footnote to fund the identified studies shall include funding necessary committee meetings, staff support and consultants to the legislature and shall be expended only upon approval of the management council.".

(a)  If 2002 House Bill 0103 is enacted into law containing authority for the state to issue revenue bonds for state capital facilities authorized by the legislature, the legislature hereby authorizes the Wyoming Technology Business Center project at the University of Wyoming, subject to subsection (b) of this section.

(b)  The project shall be funded by, and there is appropriated to the University of Wyoming, not to exceed five million dollars ($5,000,000.00) from the proceeds of state revenue bonds issued under this authorization, subject to the following:

(i)  Revenue bonds shall be issued to fund this project only to the extent that cash or binding commitments have been received by the university or the city of Laramie to match the appropriation on the basis of three dollars ($3.00) in non-general fund revenues for each five dollars ($5.00) appropriated from the state revenue bonds proceeds authorized;

(ii)  No revenue bonds shall be issued unless and until at least a total of three million dollars ($3,000,000.00) in cash or binding commitments has been received by the university or the city of Laramie to match the appropriation;

(iii)  The determination as to whether a binding commitment has been received shall be made by the attorney general;

(iv)  Cash or binding commitments shall be received not later than April 1, 2003, to be counted as matching funds under this section.

(c)  Not later than November 1, 2002, the university shall submit a report to the governor and the joint minerals, business and economic development interim committee regarding progress made toward securing matching funds.  The report shall contain plans and recommendations for funding operations of the center.".

                Section 317.

                (a)  There is appropriated from the general fund the following amounts for major buildings and facility repair and replacement that shall be expended and accounted for subject to subsections (b) and (c) of this section:

                                (i)  Two million three hundred nine thousand four hundred fifty-two dollars ($2,309,452.00) to the department of administration and information for state facilities managed by the state building commission;

                                (ii)  Five million eight hundred thousand dollars ($5,800,000.00) to the University of Wyoming for university facilities, excluding student housing, the student union and auxiliary services areas, the latter being those areas funded by university self sustaining revenues;

                                (iii)  Four million three hundred thirty-five thousand eight hundred nine dollars ($4,335,809.00) to the community college commission for community college district facilities.

                (b)  Appropriations made under subsection (a) of this section shall be separately accounted for by the recipient and shall not be subject to the provisions of W.S. 9‑4‑207(a) and (c).  Expenditures from these appropriations shall be restricted to expenses incurred for major building and facility repair and replacement as defined in subsection (c) of this section and as prescribed by rule and regulation of the department of administration and information general services division for state institutions, by rule or regulation of the university trustees for university facilities and by rule or regulation of the community college commission for community college facilities.  The general services division, the University of Wyoming and the community college commission shall annually report to the governor and the joint appropriations committee on the expenditures made from these appropriations during the applicable reporting period.

                (c)  As used in this section:

                                (i)  "Major building and facility repair and replacement" means the repair or replacement of complete or major portions of building and facility systems at irregular intervals that is required to continue the use of the building or facility at its original capacity for its original intended use, including compliance with the Americans with Disabilities Act, and is typically accomplished by contractors due to the personnel demand to accomplish the work in a timely manner, the level of sophistication of the work or the need for warranted work;

                                (ii)  "Routine maintenance and repair" means activities necessary to keep a building or facility in safe and good working order so that it may be used at its original or designed capacity for its originally intended purposes, including janitorial, grounds keeping and maintenance tasks done on a routine basis and typically accomplished by state, university or community college personnel with exceptions for any routine tasks accomplished by contractors including an elevator or other specialized equipment or building system maintenance.

                (d)  Not later than September 1, 2002, the general services division of the department of administration and information, the University of Wyoming and the community college commission shall submit a joint report to the governor and to the joint appropriations interim committee containing recommendations for a process under which requests for funding for major building and facility repair and replacement for those agencies shall be submitted based on a formula rather than by individual maintenance project.".

"1.  Of this general fund appropriation, one million dollars ($1,000,000.00) shall be distributed to the twenty-four (24) family violence programs through the distribution formula. The additional amount shall be used to supplement and not supplant any funds being distributed through that formula under the agency's approved budget request.".

Page 78-After line 37           Insert the following new section and renumber as necessary:

"[Permanent Wyoming Mineral Trust Fund Appropriation]

                Section 317.

(a)  2001 Wyoming Session Laws, Chapter 139, Section 4 which amended 2000 Wyoming Session Laws, Chapter 76, Section 300 by creating a new subsection (h), is amended to read:

(h)  Subject to the provisions of this subsection, there is appropriated to the permanent Wyoming mineral trust fund two hundred million dollars ($200,000,000.00) one hundred million dollars ($100,000,000.00). The state treasurer shall effectuate this appropriation by transferring one hundred million dollars ($100,000,000.00) from the general fund to the permanent Wyoming mineral trust fund on or before June 30, 2001. The remainder of the appropriation shall be transferred by the state treasurer from the general fund to the permanent Wyoming mineral trust fund on June 30, 2002. To the extent that insufficient unobligated funds are within the general fund to fulfill the appropriation under this paragraph, unobligated funds shall be transferred to the general fund first from the budget reserve account, next from the legislative royalty impact assistance account, and then from the statutory reserve account as necessary to complete the appropriation. If necessary to retain a balance of at least ten million dollars ($10,000,000.00) in the general fund and at least fifteen million dollars ($15,000,000.00) in the budget reserve account, the appropriation under this subsection shall be reduced by the amount of funds necessary to retain those minimum balances.

(b)  There is appropriated from the general fund fifty million dollars ($50,000,000.00) to the permanent Wyoming mineral trust fund and twenty-five million dollars ($25,000,000.00) to the permanent Wyoming mineral trust fund reserve account created by W.S. 9‑4‑713(b). The state treasurer shall effectuate this appropriation by transferring fifty million dollars ($50,000,000.00) to the permanent Wyoming mineral trust fund and twenty-five million dollars ($25,000,000.00) to the permanent Wyoming mineral trust fund reserve account on or before June 30, 2002.

(c)  This section is effective immediately.".
