Liability Claims and Legal Fees
Assumptions:
According to the Department of Transportation, WYDOT’s current expenditures average $1,198,138 per year for liability claims and legal fees on the maintenance of highways. The expenditure increase is based on projections of liability claims/lawsuits generally experienced on the average by transportation departments in other states without sovereign immunity for construction planning and design. Potential damages on claims/lawsuits for wrongful death or bodily injury are incalculable.
The fiscal impact to the judicial system is indeterminable due to an unknown number of cases.
This bill has administrative impact that appears to increase (or decrease) duties or responsibilities of one or more state agencies and may impact agency spending or staffing requirements. As introduced, the bill does not modify any state agency budget or current personnel authorizations.
