This bill contains an appropriation of $10,000,000 from the BUDGET RESERVE ACCOUNT to a medical malpractice insurance premium pool created within the trust and agency fund to pay physicians’ qualified medical malpractice insurance premiums and administrative costs incurred by the insurance commissioner in the implementation of the act.

 

The Department of Insurance is unable to estimate reimbursement levels that may be claimed under this legislation.  The agency does not collect data regarding the medical malpractice rates charged for each medical specialty or subspecialty.  Requests to surrounding state insurance departments for similar information indicated that the data is also not available in the sister states contacted. 

 

This bill has administrative impact that appears to increase (or decrease) duties or responsibilities of one or more state agencies and may impact agency spending or staffing requirements.

The following state agencies will be asked to provide their estimate of the administrative fiscal impact prior to the first committee meeting held to consider the bill:
