Summary/Major Elements:

 

·        Provides that the death penalty shall not be imposed in any first degree murder case if the murder was committed before the defendant attained the age of 18.

·        Prior law set the minimum age at 16.

 

Comments:

 

Clarifies that the death penalty will not be imposed in actions pending on the effective date of the act if the murder was committed before the defendant attained the age of 18.
