Subject:  Amends the extraterritorial authority of peace officers as specified.

 

Summary/Major Elements:

 

·         Under current law, peace officers have limitations on their authority to exercise law enforcement duties outside of their jurisdictions.

 

·         This bill:

·         Amends the extraterritorial authority of peace officers to allow peace officers to respond outside their jurisdiction:

·         To specific requests from other law enforcement officers;

·         If the peace officer has reasonable cause to believe that a crime is occurring involving an immediate threat of serious bodily injury or death to a person; or,

·         If the officer is in fresh pursuit of someone he has probable cause to believe has committed a violation of a municipal ordinance or state statute, including a traffic infraction, within the officer's jurisdiction, or if there is an outstanding warrant for the person's arrest as specified;

·         Authorizes a police chief, sheriff, their designees, or the governing body of a town without a police force to enter into agreement to allow their peace officers to perform law enforcement duties within the jurisdictions of the agreeing entities, provided certain conditions are specified in the agreement;

·         Specifies who is responsible for the peace officers' salaries and benefits and other costs and expenses related to assignments;

·         Extends protection of the state and local government self-insurance programs as specified;

·         Excludes specified peace officers from the provisions of this act;

·         Conforms provisions.
