Summary/Major Elements:

 

·        The Wyoming Supreme Court recently held that the Declaratory Judgments Act was available to review annexation actions.

 

·        Under the annexation laws, an action to review the decisions of a governing body was required to be brought within ten days of the effective date of the annexation ordinance.

 

·        This bill specifies that any action to review annexation findings and decisions of a governing body must be brought within sixty days of the effective date of the annexation ordinance, even if brought under the Declaratory Judgments Act.

 

·        The bill does not affect any litigation pending in court as of its June 1, 2004 effective date.
