Summary/Major
Elements:

Under current law, there are enhanced penalties for convictions of third
or subsequent offenses of possession of controlled substances in violation of
the Wyoming Controlled Substances Act.

This bill:
·
Specifies that convictions in other jurisdictions for violations of laws
similar to the Wyoming Controlled Substances Act shall be counted for purposes
of calculating whether an individual has been convicted of a third or
subsequent offense of possession of a controlled substance;
·
Increases the misdemeanor penalty from not more than 90 days
imprisonment, a fine of not more than $100.00, or both, to imprisonment for not
more than 6 months, a fine not to exceed $750.00, or both, for knowingly or
intentionally using or being under the influence of controlled substances in
Schedules I, II or III of the Act, except as otherwise authorized.
