Subject:  Amends time limits for reviving dormant court judgments.

 

Summary/Major Elements:

 

·        Under current law, court judgments may be revived up to 21 years after becoming dormant. Minors and other persons with legal disabilities may revive a dormant judgment within 15 years after their legal disability has ceased.

 

·        This bill:

 

·        Reduces the time for revival of a dormant judgment from 21 years to 10 years;

·        Retains the 15 year period after a legal disability has ceased to revive a dormant judgment;

·        Provides that a party in a child support proceeding may bring an action within 21 years after the judgment has become dormant.
