Subject:  Amending various provisions for filling vacancies in offices.

 

 

Summary/Major Elements:

 

·        When a vacancy occurs in various offices different provisions of law provide for filling the vacancy from the same political party to which the incumbent "belonged".  A Wyoming Supreme Court case interpreted the law regarding county commissioner vacancies, but different language was found in other provisions regarding vacancies.

 

·        This bill specifies that the party the incumbent represented at the time of election or appointment to office (as opposed to at the time of vacating office) is the controlling factor.

 

·        A person represents a party if he was that party's nominee when elected to the office or when appointed to fill a vacancy.

 

·        A number of time periods for filling vacancies are extended in order to allow political parties sufficient time to meet to nominate persons to fill vacancies.
