Subject:  Increasing penalties and length of probation for domestic violence.

 

 

Summary/Major Elements:

 

·        Under the current W.S. 6-2-501(f)(ii), a person convicted of a third or subsequent offense of simple assault or battery against a household member within the previous ten years is guilty of a felony punishable by imprisonment for not more than two years, a fine of not more than $2,000.00, or both.

 

·        This bill increases the maximum term of imprisonment under W.S. 6-2-501(f)(ii) from two years to five years.

 

·        The bill also amends W.S. 6-2-501(f)(i) by providing that the term of probation for a second offense of simple assault or battery against a household member may exceed that offense's maximum term of imprisonment of one year, provided that the term of probation together with any extension thereof shall not exceed two years.
