joint labor, health and social services interim committee shall study the costs
of providing development health and educational services to qualifying
preschool children in the state. The
committee shall work with the developmental preschool centers in the state in
developing the study design and may contract with consultants in conducting the
study. The study shall identify the
costs of service provision and recommend a mechanism for funding the costs of
providing the services. A preliminary
report shall be provided to members of the legislature not later than November
1, 2004, and a final report shall be provided by October 1, 2005.
(b) Two
hundred fifty thousand dollars ($250,000.00) is appropriated from the budget
reserve account to the legislative service office for purposes of the study
required under subsection (a) of this section.".

shall be randomly divided into two (2) groups of fifty (50) subject to the
following:
(i) One
(1) group of fifty (50) students shall be enrolled in a nonpublic school and
shall receive a payment of up to three thousand five hundred dollars
($3,500.00) during the pilot program, which shall be used to pay tuition costs
assessed by the school in which the student is enrolled. The department shall
enter into agreements with the parent or guardian of selected students to
ensure funding is used exclusively for tuition. Funding for the payments under
these agreements shall be from that portion of the school foundation program
account funded by the general fund. Any
student within this group shall not be counted within the average daily
membership (ADM) as computed for the purpose of implementing W.S. 21‑13‑309.
Home-based educational programs as defined under W.S. 21‑4‑101(a)(v)
are not eligible under this paragraph;
(ii) The
second group of fifty (50) students shall serve as a control group only and
shall be counted within the ADM of the school district in which the student
resides and attends school.
(c) The
state superintendent shall maintain a record of the results of the statewide
assessment in reading, writing and mathematics administered pursuant to law to
the one hundred (100) selected students when administered during school year 2004-2005,
comparing student performance of the two (2) groups of fifty (50) as
established under subsection (b) of this section. Information developed under
this subsection shall be used as a basis on which to make recommendations to
the legislature under subsection (d) of this section only.
(d) On
or before January 1, 2006, the state superintendent shall report to the
legislature on findings under this section with respect to the pilot program
and provide recommendations on the future of voucher system in Wyoming
education.".

purpose of establishing new or renovating existing university intercollegiate
athletics facilities consistent with the 2003 intercollegiate athletics plan
approved by the university board of trustees.
This appropriation shall be expended only to the extent the University
of Wyoming receives qualifying matching contributions from donors for athletics
facilities consistent with that plan.
To qualify as a matching contribution, the donor shall, before June 30,
2006, transfer money or other property of a value of not less than twenty-five
thousand dollars ($25,000.00) to the University of Wyoming foundation to be
expended exclusively for establishing new or renovating existing university
intercollegiate athletics facilities consistent with the 2003 intercollegiate
athletics plan approved by the University board of trustees. Not later than June 30, 2006, the University

colleges. Each community
college shall immediately transfer these funds to its foundation
to be permanently invested on behalf of the community college. Each community college shall enter
into an agreement with its foundation under which the foundation shall manage
the funds it receives under this section in the same manner as other permanent
endowment funds it manages on behalf of the community college. Only the earnings from the investment of
these funds may be expended.
(b) It is the expectation of the legislature
that the University of Wyoming will use the additional endowment provided by
this section to establish endowed chairs to be used to recruit or retain
faculty with established reputations for excellence whose presence will enhance
the educational quality and reputation of the University of Wyoming. It is expected that these faculty members
will be of sufficient quality to command a salary higher than that normally
paid a faculty member. It is the
expectation of the legislature that the community colleges will use this
endowment to recruit or retain faculty, either permanent or visiting, with
special skills in instruction or to otherwise improve the academic and
vocational quality of educational and outreach capabilities at their colleges.
(c) Not later than October 1, 2005 and 2006, the
University of Wyoming and each Wyoming community college shall report to the
joint education interim committee and the joint appropriations interim
committee regarding the expenditures made from the endowments under this
section.".

foundation under which the foundation shall manage the funds it receives under
this section in the same manner as other permanent endowment funds managed by
the University of Wyoming foundation.
Only the earnings from the investment of these funds may be expended;
(ii) Twenty-eight percent (28%) of this
appropriation shall be distributed equally to each of the Wyoming community
colleges. Each community
college shall immediately transfer these funds to its foundation
to be permanently invested on behalf of the community college. Each community college shall enter
into an agreement with its foundation under which the foundation shall manage
the funds it receives under this section in the same manner as other permanent
endowment funds it manages on behalf of the community college. Only the earnings from the investment of
these funds may be expended.
(b) It is the expectation of the legislature
that the University of Wyoming will use the additional endowment provided by
this section to establish endowed chairs to be used to recruit or retain
faculty with established reputations for excellence whose presence will enhance
the educational quality and reputation of the University of Wyoming. It is expected that these faculty members
will be of sufficient quality to command a salary higher than that normally
paid a faculty member. It is the
expectation of the legislature that the community colleges will use this
endowment to recruit or retain faculty, either permanent or visiting, with
special skills in instruction or to otherwise improve the academic and
vocational quality of educational and outreach capabilities at their colleges.
(c) Not later than October 1, 2005 and 2006, the
University of Wyoming and each Wyoming community college shall report to the
joint education interim committee and the joint appropriations interim
committee regarding the expenditures made from the endowments under this
section.".

The state treasurer shall conduct a
financial analysis for long-term investment of funds that considers the most
financially beneficial use of the state's financial resources. The analysis
shall include a debt capacity analysis of W.S. 9-4-605, an analysis of issuing
debt on a variable rate versus fixed rate basis and the development of criteria
to judge and mitigate interest rate and basis risk from each approach, and a
sensitivity analysis of investing revenue or appropriations under W.S.9-4-605
in the common school permanent land fund or other trust funds which considers
various rates of return from both fixed increase, equity investments or both.
The state treasurer shall report to the select committee on capital finance and
investments not later than July 1, 2004 on the results of this analysis. There
is appropriated to the state treasurer from the general fund twenty-five
thousand dollars ($25,000.00) for purposes of this section.".

322.
There is created the Wyoming brucellosis
task force. The Governor shall determine the appropriate number of task force
members and shall appoint individuals involved in the beef and other industries
affected by brucellosis in Wyoming. The task force shall propose
recommendations for policies, rules and legislation to combat brucellosis. The
task force may contract with consultants as necessary to perform its duties.
Members shall be compensated for mileage, per diem and other expenses in the
same manner and amount as state employees. Not later than December 31, 2004 the
task force shall report its recommendations to the Governor and the legislature.
There is appropriated from the natural resource policy account to the
department of agriculture one hundred twenty-five thousand dollars
($125,000.00) for purposes of implementing this section. Any unobligated,
unexpended funds remaining on December 31, 2004 shall revert to the natural
resource policy account.".

All appropriations to the tribes are for
the specific purposes identified. In
the event that a dispute arises over the implementation of any executed
contract regarding any appropriation, the state and the tribes agree to enter
into good faith negotiations to resolve the dispute. In the event that negotiations fail to resolve the differences,
the state and the tribes agree to non-binding arbitration. Each side shall pay the costs, if any, of
its selected arbitrator and to share the costs, if any, of the third party
arbitrator. Appropriations to the
tribes are made in recognition that tribal members are citizens of Wyoming
entitled to equal privileges.
Fulfilling the intended purposes of the appropriations are best achieved
through a cooperative approach between the state and the tribes. If the dispute cannot be resolved, the
appropriation shall remain with the state of Wyoming.".

322. Seventy-five thousand dollars ($75,000.00) is appropriated
from the general fund to the legislative service office to fund a study by the
joint corporations, elections and political subdivisions interim committee on
the current state telecommunications universal service fund, the effects of
changing the current fund from a price-based fund to a cost-based fund,
implications and desirability of supporting only a single line for each
business and residential customer receiving support through the fund, the
universal service fund subsidy level and the fund's appropriate structure. Expenditures shall fund necessary committee
staff support and consultants to the legislature, as approved by the management
council. Findings and recommendations
shall be submitted to the legislature in sufficient time for consideration
during the 2005 general session. This
section shall be effective immediately.".

Section
322.
(a) The board of land commissioners is hereby
authorized and empowered to purchase in the name of the state of Wyoming and to
pay an amount not to exceed thirty million dollars ($30,000,000.00) less costs
of appraisal or one hundred ten percent (110%) of the appraised value,
whichever is less, for the homestake lands in Crook county containing
approximately thirty thousand six hundred (30,600) acres which are hereby
declared to be state lands to be known as the homestake lands. The board of
land commissioners shall hold title to and administer the homestake lands
through the 2005 legislative session. The board of land commissioners shall
create an advisory management team consisting of not more than nine (9) members
representing, as equally as possible, the various multiple uses contemplated
for the homestake lands, including hunting and game management, livestock
grazing, snowmobiling and other recreation, forestry, historic preservation and
land conservation. The board of land
commissioners in cooperation with the management team, shall submit to the
legislature, prior to December 31, 2004, a recommendation for management and
administration of the homestake lands after the 2005 legislative session.
(b) Thirty
million dollars ($30,000,000.00), or as much thereof as is necessary, is
appropriated to the state land board from the budget reserve account for the
purposes of this section.
(c) Notwithstanding
subsection (b) of this section, two hundred thousand dollars ($200,000.00), or
as much thereof as is necessary, is appropriated from the general fund to the
state land board for necessary expenses required to review the land as provided
in subsection (e) of this section and to administer the land through the 2005
legislative session.
(d) After
consultation with members of the state land board, the Wyoming legislature
finds that purchase of the homestake lands by the state of Wyoming is feasible
and desirable to maintain open spaces, a historical recreation area,
traditional agricultural and timbering uses and turkey, elk and other species
of wildlife for the citizens of Wyoming on all or a portion of the homestake
lands and prevent possible subdivision of the lands which would impair those
uses.
(e) In
preparing and submitting a report and recommendations to the Wyoming
legislature, the land board shall specifically address at least the following
areas:
(i) The
report and recommendations shall contain information relating to reasonable
revenue estimates from ownership of the lands attributable to agricultural
leasing, timber production, recreational income, possible income from leases
with the Wyoming game and fish commission, Wyoming parks and cultural resources
commission, or any private organizations and any other possible uses;
(ii) A
complete and comprehensive appraisal of the lands including the amount of
property taxes currently being paid to local governments on the lands. The property shall be retained on the tax
rolls and the land board shall recommend sources for state or private payment
of future taxes;
(iii) The
result of meetings or hearings with interested persons and governmental
entities in the area, state agencies and other members of the Wyoming
public. The report shall make
recommendations regarding how the lands should be managed and administered in
the future;
(iv) Possibilities
for future exchanges of some portions of the lands with the federal government
to increase access to existing federal lands, increase timber available to
sustain private timber production in the area, recreational, agricultural and
other values of importance to the Wyoming public and portions of the lands, if
any, that might be suitable for privatization and public sale in the future;
(v) Any
other matters of significance as determined by the members of the state land
board.
(f)
This section is effective immediately.".

322.
(a) There
is appropriated from the general fund to the legislative service office
forty-five thousand dollars ($45,000.00) to be used to establish and support a
joint executive-legislative committee on split estates to study issues and
draft legislation to modernize Wyoming statutes with respect to estates in
which the mineral rights and surface rights are held by different parties.
(b) The
committee shall consist of nine (9) members including:
(i) Three
(3) appointees selected by the governor;
(ii) Three (3) members of the house of
representatives, with not more than two (2) members from the same political
party. The members shall be appointed
by the speaker of the house, who shall also appoint one of the members as
cochairman of the committee. One (1) member
each shall be from the house standing:
(A) Agriculture, public lands and water
resources committee;
(B) Judiciary committee;
(C) Minerals, business and economic development
committee.
(iv) Three
(3) members of the senate, with not more than two (2) members from the same
political party. The members shall be
appointed by the president of the senate, who shall also appoint one of the
members as cochairman of the committee.
One (1) member each shall be from the senate standing:
(A) Agriculture, public lands and water
resources committee;
(B) Judiciary committee;
(C) Minerals, business and economic development
committee.
(c) State
agencies shall provide information and other support to the committee as
requested. The legislative service
office shall staff the committee. The
committee shall meet as necessary and shall report to the joint judiciary
interim committee its recommendations for statutory changes not later than
November 1, 2004. The committee may
request the presence of and hear testimony from any person relating to the
subject of split estates, specifically including but not limited to
representatives of:
(i) The oil and gas industry;
(ii) Private landowners affected by split
estates;
(iii) Private mineral estate owners affected by split
estates;
(iv) A state with an accommodation doctrine in
its state laws;
(v) The banking industry;
(vi) Rural land appraisers.".
