Source of revenue increase:

Each background check requires submission of fees for processing.  By statute, the fee for the state check is $15 (W.S. 7-19-108), and the fee for the federal background check is $24. The state fee is placed in the General Fund while the FBI bills DCI on a monthly basis to collect the federal fee.  While a state can opt to conduct state background checks only, the FBI background check cannot occur without a state background check having first been conducted.

 

Assumptions:

This fiscal impact review is based on information provided by the Wyoming Real Estate Commission, and from information on the number of “state-only” background checks conducted for the Wyoming Real Estate Commission in 2005.  According to Wyoming Real Estate Commission staff, along with the estimated 550 background checks for real estate brokers and sales-persons (which are currently required), an estimated 100 appraiser checks would be sent to DCI annually.

 

No significant fiscal or personnel impact to the Wyoming Real Estate Commission.
