Source of Revenue Increase:

The bill as presented authorizes the release of criminal history information to public fire departments and fire protection districts. Each background check requires submission of fees for processing.  By statute, the fee for the state check is $15.00 (W.S. 7-19-108), and the fee for the federal check is $24.00.  The state fee is placed in the state general fund while the FBI bills Division of Criminal Investigation on a monthly basis to collect the federal fee.  While a state can opt to conduct state checks only, the FBI check cannot occur without a state check having first been conducted.

 

The fiscal impact review is based on information compiled from the Wyoming Department of Fire Prevention and Electrical Safety (WDFPES).  According to WDFPES, in 2005, there were 158 fire departments in the state of Wyoming staffed by 4,410 paid or volunteer fire-fighters.  The average number of new fire-fighters, volunteer or paid, could not be obtained.  Without the known turnover rate, the Attorney General’s Office cannot reasonably ascertain the revenue increases if the intent is to only background new employees after the effective date of the legislation.
