"(a) Notwithstanding sections 1 and 2 of this act, the department of education shall rebate to school districts any recapture payments made by districts which exceed the maximum amount allowable under W.S. 21-13-102(c) as in effect prior to July 1, 2007, and which were made by the districts during fiscal year 2006-2007. The maximum recapture amount shall be based upon fiscal year 2005-2006 actual data. Rebated amounts authorized under this subsection shall be paid by the department on or before July 1, 2007.
(b) Fiscal year 2006-2007 rebated amounts pursuant to subsection (a) of this section shall be accounted for and excluded from the calculation of operating balance and cash reserves under W.S 21-13-313(e) for purposes of determining fiscal year 2007-2008 foundation program payments under W.S. 21‑13‑311 and recapture under W.S. 21-13-102. This subsection shall apply to fiscal year 2007-2008 computations only and shall not apply to fiscal year 2008-2009 or any fiscal year thereafter.".
