AN ACT relating to the Medical Assistance and Services Act; expanding the list of third party payors to which the department's right of subrogation attaches; providing that the department's right of subrogation supersedes other statutes; providing that third party payors, as a condition of doing business, cooperate as specified in satisfying the department's subrogation right; and providing for an effective date.

            "(v)  Coverage information requested pursuant to paragraph (i) of this subsection for the entities listed in this paragraph shall be limited to whether a specified individual, spouse or child has coverage and, if so, a description of the coverage.  Such information shall be used to determine an individual's eligibility for state benefit programs, including the medical assistance program and to coordinate benefits with a state program.  This paragraph shall apply to a disability insurance policy that is not legally responsible for payment of a claim for health care items or services by statute, contract or agreement and consist of one (1) or more, or any combination of the following:

                  (A)  Coverage only for accident income insurance or disability income insurance;

                  (B)  Coverage only for specified diseases or illnesses; or

                  (C)  Coverage only for hospital indemnity or other fixed indemnity insurance.".  LANDON, CHAIRMAN
