"(ii)  If a specialty hospital does not provide emergency services it shall:

(A)  Establish procedures to stabilize a patient with an emergency medical condition until the patient is transported or transferred to another hospital if emergency services cannot be provided to meet the needs of the patient in an emergency;

(B)  Enter into a transfer agreement with any other community hospital for patients not covered under the Emergency Medical Treatment and Labor Act, whose condition develops into an emergency beyond the capability of the specialty hospital.

(iii)  If a specialty hospital does provide emergency services it shall participate in the Wyoming Emergency Medical and Trauma System as a hospital with specialized capabilities.

(b)  To be licensed under this chapter, specialty hospitals shall not be required to:

(i)  Admit patients with diagnoses and conditions that extend beyond its capability of services;

(ii)  Act as an access point for care for patients in nonurgent cases;

(iii)  Admit patients for general medical conditions;

(iv)  Act as first responders during disasters;

(v)  Be primarily engaged in inpatient care as required by the center for Medicare and Medicaid Services for hospitals.".
