FISCAL NOTE

This bill allows the “design-build” construction delivery method to be used for public improvement construction projects.

This bill provides that all unsuccessful respondents to a response for a fixed scope request for proposal or fixed price request for proposal shall be compensated at not less than one-tenth of one percent (0.1%) of the price of the project as proposed by the successful respondent.

The Department of Administration and Information indicated that the state’s current delivery methods do not require payment to unsuccessful bidders or respondents. Therefore this provision would increase expenditures by the amount of payments to unsuccessful bid respondents.

The Wyoming Department of Transportation estimated an annual expenditure increase of $15,000 per year from the State Highway Fund resulting from these payments to unsuccessful respondents, under the assumption that this provision would apply to buildings only (not highway infrastructure).
