(b)  2007 Wyoming Session Laws, Chapter 186, Section 2(c), (e) and by creating a new subsection (f) and Section 3(b) are amended to read:

 

Section 2.

 

(c) The task force shall issue a report to the governor and the joint minerals, business and economic development interim committee no later than September 30, 2007 September 30, 2008 and 2009 including, but not limited to, recommendations regarding funding specific proposals for research into clean coal technologies in Wyoming.

 

(e) The task force shall exist until September 30, 2008 June 30, 2010. Members of the task force who are not legislators shall not receive a salary but shall receive reimbursement for necessary travel and per diem expenses in the manner and amount provided for state employees under W.S. 9-3-102 and 9-3-103. Members of the task force who are legislators shall be paid salary, per diem and travel expenses as provided in W.S. 28-5-101 for their official duties as members of the task force.

 

(f) If paragraph (a)(vii) of section 321 of this bill is enacted into law, the clean coal task force may award funding provided under that paragraph to proposals for clean coal after submitting the task force’s recommendations to the joint minerals, business and economic development interim committee for review and comment.

 

 

Section 3.

 

(b) There is appropriated two million five hundred thousand dollars ($2,500,000.00) from the general fund to a separate account for the purpose of clean coal technology research. Funds deposited in the account shall not be expended until a dollar for dollar match has been provided from nonstate funds, and only upon appropriation by the legislature. Notwithstanding W.S. 9-2-1008 or 9-4-207, unexpended funds shall revert on June 30, 2009 June 30, 2010.”.

            Section 323.

 

(a)  The Wyoming transportation commission shall administer a program, in conformity with the standards prescribed in 49 C.F.R. 222, for the establishment of quiet zones or the installation of wayside horns to minimize the sounding of locomotive horns in populated areas.

 

(b)  Funds appropriated by the legislature for the program created by this section shall be maintained in a subaccount within the account established pursuant to W.S. 37‑10‑101 and shall be used only for the quiet zone and wayside horn program, but may be combined with other state and federal funds when a quiet zone or wayside horn is included as one of the safety devices to be installed in a grade crossing improvement project.

 

(c)  The commission shall establish a priority rating system for the establishment of quiet zones or the installation of wayside horns at grade crossings, giving due consideration from the applications or evidence before the commission to safety, the population density in the area where locomotive horns must be sounded before grade crossings, the number and scheduling of trains using the affected grade crossing, anticipated increases in population and rail traffic volume, the cost effectiveness of required improvements and other factors deemed relevant by the commission.

 

(d)  Except as provided in this section, expenditures from the wayside horn subaccount shall be subject to the provisions of Wyoming statutes, title 37, chapter 10.

 

(e)  The department of transportation shall annually report to the joint transportation, highways and military affairs interim committee by October 1, 2008 and 2009 regarding the expenditure of funds from the subaccount created by this section, the number of quiet zones established and wayside horns installed and the status of the priority list and schedule for future quiet zone establishment and wayside horn installations.

 

(f)  There is appropriated one million dollars ($1,000,000.00) from the general fund to the subaccount created by this section.  This appropriation shall be for the period beginning with the effective date of this section and ending June 30, 2010.  This appropriation shall only be expended for the purpose of the quiet zone and wayside horn program established by this section.  Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert as provided by law on June 30, 2010.

 

(g)  The department of transportation shall report annual expenditures made pursuant to subsection (a) of this section to the state treasurer on June 30, 2009 and 2010.  Upon receiving the reports, the state treasurer shall transfer from funds available in the abandoned mine land funds reserve account to the general fund an amount equal to the amounts of the expenditure reported.

 

(h)  The department of transportation shall include a request for funds in its 2011-2012 budget request to continue funding for the quiet zone and wayside horn program at levels provided under this section from funds deposited in the abandoned mine land funds reserve account.

 

(j)  This section shall not be effective if 2008 House Bill 108 is enacted into law.".

The purpose of this appropriation is to permit the community colleges and university to implement the plan during the first two (2) years of a three (3) year phase-in period. Of this appropriation:

            Section 324. 

 

(a)  There is appropriated:

 

(i) Seven hundred seventy-one thousand two hundred ten dollars ($771,210.00) from the general fund to the university of Wyoming school of energy resources to be expended for the advancement of uranium energy resources and nuclear power with an emphasis on advancing uranium in situ recovery;

 

(ii) One million dollars ($1,000,000.00) from the common school permanent fund reserve account created by W.S. 9-4-713(f) to the university of Wyoming school of energy resources to be expended for the advancement of uranium energy resources and nuclear power with an emphasis on advancing uranium in situ recovery.".
