The fiscal impact is indeterminable.

 

The proposed legislation will conform to the current Unemployment Insurance Division (the "Division") policy stating that a claimant may be disqualified for a misconduct discharge if it is found that the claimant failed or refused a drug test.  This disqualification also applies to results for pre-employment drug tests.  Appropriate fact finding by the Division includes determining if the claimant was aware of the employer's policy and if the policy was adhered to.  The actual amount of revenue that would result based on this legislation cannot be determined.
