Catch Title: Uniform law on notarial acts.
Subject: Adopting the uniform law on notarial acts.
Summary/Major Elements: This act:
· Creates the Wyoming Uniform Law on Notarial Acts by adopting the Uniform Law on Notarial Acts;
· Establishes who can take "notarial acts" in Wyoming;
· Guides a notarial officer's process for taking acknowledgments, taking verifications upon oath or affirmation, witnessing or attesting a signature, certifying or attesting a copy, certifying an instrument executed by a business, certifying instruments executed by a trustee, testamentary trust or express trust and for making or noting the protest of a negotiable instrument;
· Sets standards for recognizing notarial acts taken outside of Wyoming;
· Establishes standards for establishing a person's identity; and
· Defines the contents of a notarial certificate.
· Provides sample certificate forms for various types of notarial acts.
· Exempts from coverage notarial acts taken before its effective date.
· Amends the existing statutes by specifying the officers who can administer oaths, but who cannot take other notarial acts.
· Repeals Wyoming's Acknowledgement Act.
· Repeals W.S. 34-1-126 which imposed a fine on county clerks for recording improperly notarized documents.
