Summary/Major Elements:

· This act:

·   Directs the department of health to estabish a cost-based system of reimbursing service providers in the home and community based waiver programs for persons with developmental disabilities or acquired brain injury;

· Specifies the data to be used in the reimbursement system, requires that it be developed in consultation with providers, client families and a contracted expert and requires providers to provide actual cost data to the department;

· Makes the new reimbursement system effective for individual budget amounts established after June 30, 2008, contingent on approval by the federal Center for Medicare and Medicaid Services;

· Requires the establishment of a new base period for calculating provider reimbursement rates every two to four years.

Comments:

· The act appropriates $3,886,115 from the general fund and $3,886,115 from federal funds for increases in provider payments under the cost-based reimbursement system through June 30, 2010.
