Summary/Major Elements:

· Allows for payment of rents due (in a case based on failure to pay rent) at "the time of the hearing" and not at "the time of the commencement of the action".  This would allow the plaintiff to collect rents due during the period from the commencement of the action to the hearing if the defendant were a hold-over tenant.

· Allows for a judgment for attorney's fees if provided for in the lease in a case based on failure to pay rent.
