Summary/Major Elements:

· Current law, W.S. 24-9-101 through 103, establishes a procedure for landowners to petition for establishment of a private road to gain access to their property if there is no direct access to a public road.

· This act amends the statutory procedure by providing for the county commissioners, after conducting a hearing to determine if the property has no access to a public road, to certify the petition to the district court for locating the private road, unless the commissioners elect to retain jurisdiction.
