1. Of this general fund appropriation, six hundred fifty thousand dollars ($650,000.00) for the business training and outreach program is effective immediately.

2. The department shall develop policies to ensure that funds appropriated for the business training and outreach program are distributed on a prioritized needs basis.

3. Of this general fund appropriation, three hundred sixty-five thousand dollars ($365,000.00) shall only be expended for the purposes of providing business planning assistance and advice regarding available financial services to Wyoming childcare providers.  These funds shall only be used to contract with any contractor who has demonstrated the ability to analyze childcare financing projects, can provide targeted business development assistance, has knowledge of other sources of public and private financing for childcare providers and knowledge of childcare and early childhood education development, improvement and financing.".

"13.  Of this other fund appropriation, one hundred fifty thousand dollars ($150,000.00) shall only be expended to create and operate the cardiovascular disease education and outreach initiative program.  The goal of the program shall be to reduce through education, prevention and behavior change the number of people with diabetes who are at risk for developing cardiovascular disease, and to provide diagnostic, therapeutic and behavioral interventions to persons diagnosed with diabetes.  The program shall provide education and outreach to demonstrate the relationship between heart disease and diabetes and the steps available to prevent both conditions, shall provide services for the early detection, screening, diagnosis and treatment of diabetes related cardiovascular disease and shall provide to health care providers, diabetes educators and cardiac rehabilitation facilities a research and data collection system for the monitoring of diabetes patient care and collection of data related to blood pressure, blood lipids and glucosylated hemoglobin levels.  The department of health may contract with third parties to accomplish the purposes of this appropriation.".

(A)  Review Wyoming's current electrical production capacity and estimate any changes in those capacities which may occur as the result of new technologies or by developing alternate electric sources including nuclear, solar, wind and geothermal sources;

(B)  Review Wyoming's projected needs for future interstate and intrastate electrical generation transmission;

(C)  Review the volume of current and future projected in-state and interstate use of electricity and the generation capacity of electricity in this state in light of the amount of electricity that is exported from this state;

(D)  Review the economic impacts of:

(I)  The number of jobs that are generated by the construction of electrical generation facilities in this state during and after construction;

(II)  The amount of ad valorem property taxes paid by electrical generation companies and the entire electrical generation industry in this state;

(III)  The amount of all taxes paid regionally and the amount of taxes received by this state from all electrical generators;

(IV)  The potential impacts and benefits, including costs to users, of all electrical generation tax policies.

(E)  Review the possibility of new development and the impacts of that development on land, air, wildlife and water quality;

(F)  Review the potential impact that eminent domain actions may have on electrical generation facility development including land currently acquired by eminent domain and the potential land to be acquired for new electrical generation;

(G)  Contain an analysis of value added return on new electrical generation and transmission in light of the potential exportation of electricity from this state.".

      Section 345.

      (a)  Every state agency expending state funds in the period from July 1, 2008 through September 30, 2009, to advertise in any communication medium a program administered by or a service provided by the agency, to espouse a position of the agency or to educate the public shall report the expenditures to the joint appropriations committee, with a summary provided to the legislature, on or before October 30, 2009.  The report shall include the amount of each expenditure, the entity receiving the payment, the purpose for the advertisement and the source of the funding.  As used in this section:

(i) "Communication medium" includes television, radio, newspaper, magazine, billboard and the Internet, World Wide Web or a similar proprietary or common carrier electronic system;

(ii)  "State agency" means an office, department, board, commission, authority, instrumentality or operating unit of the executive, legislative or judicial department of state government.  "State agency" does not include the University of Wyoming or any community college.".

The state treasurer is authorized to borrow from pooled fund investments an amount necessary to meet cash flow requirements of the Hathaway scholarship program. The treasurer shall borrow funds under this section only to assist the month-to-month cash flow of the program and shall not borrow funds under this section when total expenditures together with outstanding encumbrances and obligations for a fiscal year exceed projected revenues and fund balances available for that fiscal year for the program. (i)  The department shall ensure documentation and standardization of education data warehouses no later than June 30, 2010;

(ii)  The department shall provide technical assistance to school districts such that by not later than June 30, 2010, each district's student information system implements school interoperability framework protocols as directed by department rule and regulation;

(iii)  The department shall address agency school finance and student assessment information silos such that data collection and analysis are allowed to cross department organizational boundaries providing dual data collection and analysis;

(iv)  School districts shall use professional development funds available within the school foundation program amount computed and distributed under W.S. 21‑13‑309(p) for purposes of training and developing appropriate employees in the use of student information generated under school finance information systems and translation of this information into the evaluation and improvement of student achievement and teacher performance;

(v)  The department shall establish and provide district training programs directed at ensuring validity and integrity of district data entry into the information system.

(b)  Up to two hundred fifty thousand dollars ($250,000.00) of this other fund appropriation shall be expended by the department to carry out subsection (a) of this footnote and to transform education data, student information system data and school finance data into usable information to assist the legislature, the department, school districts and external stakeholders and to coordinate statewide education and school finance data analysis efforts.  The department is authorized one (1) additional at-will full-time position to serve as the department education information officer and the department may use this appropriation for necessary contractual expertise to implement this footnote.

(c)  The department shall report progress under this footnote to the joint appropriations committee and the joint education interim committee not later than November 1, 2009, enumerating student information system improvements, reconstruction efforts and district compliance with system requirements, together with detailed statements of expenditures of amounts appropriated under this footnote.

(d)  In addition to subsection (c) of this footnote and not later than November 1, 2009, the department shall report to the joint education interim committee on the application of modifications and improvements to the student information system in accordance with this footnote, to recalibration of the education resource block grant model under W.S. 21‑13‑309(t), the allocation and use study effort on education resources conducted under 2008 Wyoming Session Laws, Chapter 95, Section 801, and to other ongoing school finance issues under review by the committee.".

(a)  There is created a select committee on wind energy consisting of the following members:

(A)  The joint minerals, business and economic development interim committee;

(B)  The joint corporations, elections and political subdivisions interim committee; and

(C)  The joint revenue interim committee.

(i)  Statutes relating to the authority of the industrial siting division of the department of environmental quality;

(ii)  Statutes relating to the authority of the public service commission;

(iii)  Statutes related to county zoning authority;

(iv)  Any relevant federal statutes that may preempt or limit state or county authority; and

(v)  Other issues relating to the wind energy conversion industry the committee may determine to be relevant, including the appropriate agency, or agencies as may be necessary, to regulate the industry, how such regulation of the industry should be funded, the process for decommissioning of facilities and wind generation tax policies, avoiding duplication of conflicting requirements and effects on state trust lands.

(d)  The select committee shall submit its recommendations, including proposed legislative changes, to the legislature and the governor no later than November 1, 2009 for consideration by the legislature in the 2010 budget session with respect to the issues specified in subsection (c) of this section.

(e)  The select committee shall terminate December 31, 2009.

      Section 345.

(a)  Subject to subsection (f) of this section, a person who occupies a specified dwelling is entitled to a tax exemption as provided by subsection (d) of this section.  Not more than one (1) tax exemption shall be allowed on the same piece of property during any year.

(b)  A person who wishes to claim an exemption under this section shall file a sworn statement on or before the fourth Monday in May, 2009 on the form provided by the department of revenue and mailed to the applicant by the county assessor with an annual assessment of the property for tax purposes.  False claims by an applicant are punishable as provided in W.S. 6‑5‑303.  The applicant shall swear or affirm that:

(i)  At the time of claiming the exemption he is the owner of the dwelling and it is his primary residence;

(ii)  He has not claimed a tax exemption in any other state or in any other county in Wyoming for that calendar year;

(iii)  The dwelling has been occupied by the applicant since the beginning of the calendar year.

(c)  The county treasurer shall collect from the property owner the amount of the tax due less any tax exemption under this section.  On or before September 1, 2009, county assessors shall certify the exemptions granted pursuant to this section to the department.  On or before October 1, 2009 the state treasurer shall reimburse each county treasurer for the amount of taxes which would have been collected if the exemption under this section had not been granted.  The county treasurer shall distribute to each governmental entity the actual amount of revenue lost due to the tax exemption.

(d)  The exemption under subsection (a) of this section is four thousand dollars ($4,000.00) of assessed value of the dwelling not to exceed fifty percent (50%) of the assessed value of the dwelling.

(e)  Every person holding an escrow for the payment of taxes on property owned by another shall notify the owner of the property of the amount of the exemption allowed to the owner under this section on or before October 1, 2009.

(f)  The exemption authorized by this section is allowed for taxes assessed and levied during the 2009 calendar year.    In adopting this method of exemption of property taxes and providing that no local government shall incur any loss of property tax revenue under subsection (c) of this section, any bond issues or other matters relying upon the assessed value of a local government for computation shall be predicated upon the assessed value of the local government before computation of the tax exemption under this section.

(g)  As used in this section:

(i)  "Applicant" means:

(A)  A person who occupies and owns a homestead either solely or jointly with his spouse;

(B)  A person who occupies a homestead as a vendee in possession under a contract of sale;

(C)  A person who occupies a homestead owned by a corporation primarily formed for the purpose of farming or ranching if the person is a shareholder or is related to a shareholder of the corporation; or

(D)  A person who occupies a homestead owned by a partnership primarily formed for the purpose of farming or ranching if the person is a partner or is related to a partner in the partnership.

(ii)  "Dwelling" means a house, trailer house, mobile home, transportable home or other dwelling place.

(h)  There is appropriated thirty-six million two hundred thousand dollars ($36,200,00.00) from funds appropriated to the capitol building rehabilitation and restoration account created by 2008 Wyoming Session Laws, Chapter 123, to the state treasurer.  This appropriation shall be for the period beginning with the effective date of this act and ending December 31, 2009.  This appropriation shall only be expended for the purposes of this section.  Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert as provided by law on December 31, 2009.".

(a)  On or before May 5, 2009, each state entity receiving state funds shall submit to the governor a plan to operate with a reduction of five percent (5%) in state funds and a plan to operate with a reduction of ten percent (10%) in state funds from the amounts provided in each entity's budget in 2008 Wyoming Session Laws, Chapter 48, Section 2, as amended by this act.  The plans shall be drafted in accordance with the following:

(i) The reductions shall be sustainable, allowing the entity to operate under the reduced funding levels in the 2011-2012 biennium and beyond;

(ii) Specific functions shall be identified for reduction or elimination rather than "across the board" reductions;

(iii) The reduction shall continue to allow an increase in employee salaries in fiscal year 2010 of four percent (4%) above the levels provided in the 2009 fiscal year;

(iv)  Elimination of vacant positions or reductions in positions by attrition may be included, but plans shall avoid displacing employees;

(v) Plans may consider and acknowledge potential loss of federal funding accompanying the state funding reduction, but any such potential loss shall not be the basis for not taking an action to operate under reduced funding.

(b)  As used in this section "state entity" means an office, department, board, commission, authority, instrumentality, institution, or other operating unit of the executive or judicial department of state government and includes the University of Wyoming and each community college.".

[BUDGET REDUCTION AUTHORITY - REVENUE SHORTFALL]

Section 311.

The governor shall review all agency budgets and expenditures every six (6) months. If the governor determines during the review that the probable receipts for the next six (6) month period from taxes or other sources of revenue for any fund or account will be less than were anticipated, and if the governor determines that these receipts plus existing revenues in the fund or account, which are available for the next six (6) month period will be less than the amount appropriated, the governor, within sixty (60) days after reviewing the budget, shall give notice to the state agencies concerned and reduce the amount appropriated to prevent a deficit.  This section shall apply to all appropriations in this act and to those in 2008 Wyoming Session Laws, Chapter 48, regardless of whether the appropriation is for a specified project or purpose, including but not limited to capital construction projects.  This section shall apply whether the appropriation is to be expended directly by an agency or is made to an agency for distribution to another entity.  As used in this section "agency" includes an authority, board, commission, council, department, institution, instrumentality, office and other separate operating agency or unit of the executive and judicial department of state government and includes the University of Wyoming and each community college.".

"[AMERICAN RECOVERY AND REINVESTMENT ACT]

Section 345.

(a)  Funds provided to the state pursuant to the American Recovery and Reinvestment Act of 2009 shall be subject to the following:

(i)  Funds provided directly or indirectly to a state agency shall only be expended in accordance with the requirements of the B-11 process as authorized by W.S. 9‑2‑1005(b)(ii).  These funds shall not be included in any agency’s 2011-2012 standard biennial budget request;

(ii)  All other funds provided to the state, or to be provided to political subdivisions or other entities through the state or a state agency, may be distributed for expenditure as provided in the act only upon approval of the governor;

(iii)  All funds received by the state from the federal government under the act which are not expended pursuant to paragraph (i) or (ii) of this subsection shall be deposited into a legislative economic stimulus account.

(b)  The governor shall promptly report to the joint appropriations interim committee and the management council all funds made available to the state under the act, specifying:

(i)  All funds subject to expenditure or distribution pursuant to paragraph (a)(i) of this section;

(ii)  All funds subject to expenditure or distribution pursuant to paragraph (a)(ii) of this section;

(iii)  For any funds not subject to expenditure or distribution under paragraph (a)(i) or (ii) of this section, the purposes for which funds are made available, requirements for expenditure, the date by which the funds must be expended and any condition the governor recommends be imposed upon any expenditure.

(c)  Each city, town or county in this state receiving funds under the act directly from the federal government shall report on or before December 1, 2009 to the governor and the joint appropriations interim committee all funds received under the act which were not reported pursuant to subsection (b) of this section.

(d)  As used in this section:

(i)  "Act" means the federal American Recovery and Reinvestment Act of 2009;

(ii)  "State agency" means the state of Wyoming or any of its branches, agencies, authorities, departments, boards, commissions, councils, instrumentalities, office, separate operating agencies or units, or institutions, including the university and community colleges.

[TASK FORCE ON WIND ENERGY]

      Section 346.

(a)  Provided the management council does not assign the issue of wind energy to a standing committee as a 2009 interim topic, there is created a task force on wind energy consisting of the following members:

(i)  Three (3) members of the Wyoming senate, appointed by the president of the senate;

(ii)  Four (4) members of the Wyoming house of representatives, appointed by the speaker of the house;

(iii)  Two (2) members from the public-at-large appointed by the governor;

(iv)  Not more than two (2) senators and three (3) representatives shall be from the same political party.

(b)  The task force members shall select a chairman and vice-chairman from among their membership. The task force shall be staffed by the legislative service office.  State agencies shall provide information and assistance to the task force as requested.

(c)  The task force shall study the following, as they relate to regulation and taxation of the wind energy conversion industry:

(i)  Statutes relating to the authority of the industrial siting division of the department of environmental quality;

(ii)  Statutes relating to the authority of the public service commission;

(iii)  Statutes related to county zoning authority;

(iv)  Any relevant federal statutes that may preempt or limit state or county authority; and

(v)  Other issues relating to the wind energy conversion industry the task force may determine to be relevant, including the appropriate agency, or agencies as may be necessary, to regulate the industry, how such regulation of the industry should be funded, the process for decommissioning of facilities, and wind generation tax policies, avoiding duplication of conflicting requirements and effects on state trust lands.

(d)  The task force shall submit its recommendations, including proposed legislative changes, to the legislature and the governor no later than November 1, 2009 for consideration by the legislature in the 2010 budget session with respect to the issues specified in subsection (c) of this section.

(e)  The task force shall exist until December 31, 2009.  Members of the task force who are not state employees or legislators shall not receive a salary but shall receive reimbursement for mileage and per diem expenses at the rate provided for legislators under W.S. 28‑5‑101.  Members of the task force who are legislators shall be paid salary, per diem and mileage as provided in W.S. 28‑5‑101 for their official duties as members of the task force.

(f)  There is appropriated from the general fund:

(i)  Ten thousand five hundred dollars ($10,500.00) to the legislative service office for payment of salary, per diem and mileage for legislative task force members;

(ii)  Two thousand dollars ($2,000.00) to the governor's office for payment of authorized per diem and mileage for nonlegislative task force members.

[WATER DEVELOPMENT ACCOUNT - APPROPRIATION]

Section 347.

There is appropriated from the general fund three million dollars ($3,000,000.00) to water development account I.

[MINERAL SEVERANCE TAX DIVERSION]

      Section 348.  W.S. 39‑14‑801(b) is amended to read:

39‑14‑801.  Severance tax distributions; distribution account created; formula.

(b)  Before making distributions from the severance tax distribution account under subsections (c) through (e) of this section, an amount equal to two-thirds (2/3) of the amount of tax collected under W.S. 39‑14‑104(a)(i) and (b)(i) and 39‑14‑204(a)(i) for the same period shall be deposited into the permanent Wyoming mineral trust fund,. except that for the fiscal year 2010 these funds shall be deposited as follows:

(i)  Fifty percent (50%) to the permanent Wyoming mineral trust fund; and

(ii)  Fifty percent (50%) to the permanent Wyoming mineral trust fund reserve account created by W.S. 9‑4‑719(b).".

To the extent required adjust totals; and renumber as necessary.
