1. Of this general fund appropriation, six hundred fifty thousand dollars ($650,000.00) for the business training and outreach program is effective immediately.

2. The department shall develop policies to ensure that funds appropriated for the business training and outreach program are distributed on a prioritized needs basis.

3. Of this general fund appropriation, three hundred sixty-five thousand dollars ($365,000.00) shall only be expended for the purposes of providing business planning assistance and advice regarding available financial services to Wyoming childcare providers.  These funds shall only be used to contract with any contractor who has demonstrated the ability to analyze childcare financing projects, can provide targeted business development assistance, has knowledge of other sources of public and private financing for childcare providers and knowledge of childcare and early childhood education development, improvement and financing.".

(D)  Review the economic impacts of:

(I)  The number of jobs that are generated by the construction of electrical generation facilities in this state during and after construction;

(II)  The amount of ad valorem property taxes paid by electrical generation companies and the entire electrical generation industry in this state;

(III)  The amount of all taxes paid regionally and the amount of taxes received by this state from all electrical generators;

(IV)  The potential impacts and benefits, including costs to users, of all electrical generation tax policies.

(E)  Review the possibility of new development and the impacts of that development on land, air, wildlife and water quality;

(F)  Review the potential impact that eminent domain actions may have on electrical generation facility development including land currently acquired by eminent domain and the potential land to be acquired for new electrical generation;

(G)  Contain an analysis of value added return on new electrical generation and transmission in light of the potential exportation of electricity from this state.".

Section 345.

(a)  There is created the legislative economic stimulus account.  To the extent not prohibited by federal law, all funds received by the state from the federal government under the American Recovery and Reinvestment Act of 2009 shall be deposited into the account.

(b)  Except as provided in this section, all funds and all income generated on the funds in the account shall remain in the account until appropriated by the legislature.

(c)  Funds in the account are appropriated as follows:

(i)  Funds specified by the Act to be used for projects administered by the transportation commission or the department of transportation are hereby appropriated to the department to be expended by the highway commission in the amount appropriated by the Act for the purposes specified by the Act.   As used in this paragraph "projects" includes only repair or construction of roads, highways and bridges;

(ii)  Funds specified by the Act to be distributed to a tribal entity are hereby appropriated to the state auditor in the amount appropriated by the Act to be distributed as provided by the Act.

(d)  The governor shall promptly report to the joint appropriations committee all funds made available to the state under the Act, specifying the purposes for which funds are required to be expended under the Act and, if applicable, the date by which the funds must be expended, identifying those funds available for nonspecified purposes and making recommendations as the governor deems advisable for the appropriation and expenditure of funds under the Act, including any condition recommended to be imposed upon any expenditure.

(e)  Funds in the account not appropriated under subsection (c) of this section are subject to the following:

(i)  The joint appropriations committee shall review the governor's report and recommend to the presiding officer of each house of the legislature whether the legislature should convene in special session if the governor has not called for a special session;

(ii)  If the legislature does not schedule a special session within twenty-one (21) days after receipt of the governor's report or if the president of the senate and the speaker of the house advise the governor in writing that they do not intend to call a special session, there is hereby appropriated from the account to the state entity specified by the Act the amounts provided under the Act.  If no state entity is specified, the governor is authorized to determine the most appropriate state entity to fulfill the function, and the amount is hereby appropriated to the state auditor for distribution to the entity as designated by the governor.  All appropriations under this paragraph are subject to any conditions the governor recommended be imposed under the report submitted under subsection (d) of this section.

(f)  All expenditures made pursuant to subsection (c) or (e) of this section shall be reported through the B-11 process and shall not be included in any agency’s 2011-2012 standard biennial budget request.

(g)  As used in this section:

(i)  "Account" means the legislative economic stimulus account created by this section;

(ii) "Act" means the federal American Recovery and Reinvestment Act of 2009;

(iii)  "State" means the state of Wyoming or any of its branches, agencies, departments, boards, instrumentalities, separate operating units, or institutions.".

(i)  The department shall ensure documentation and standardization of education data warehouses no later than June 30, 2010;

(ii)  The department shall provide technical assistance to school districts such that by not later than June 30, 2010, each district's student information system implements school interoperability framework protocols as directed by department rule and regulation;

(iii)  The department shall address agency school finance and student assessment information silos such that data collection and analysis are allowed to cross department organizational boundaries providing dual data collection and analysis;

(iv)  School districts shall use professional development funds available within the school foundation program amount computed and distributed under W.S. 21‑13‑309(p) for purposes of training and developing appropriate employees in the use of student information generated under school finance information systems and translation of this information into the evaluation and improvement of student achievement and teacher performance;

(v)  The department shall establish and provide district training programs directed at ensuring validity and integrity of district data entry into the information system.

(b)  Up to two hundred fifty thousand dollars ($250,000.00) of this other fund appropriation shall be expended by the department to carry out subsection (a) of this footnote and to transform education data, student information system data and school finance data into usable information to assist the legislature, the department, school districts and external stakeholders and to coordinate statewide education and school finance data analysis efforts.  The department is authorized one (1) additional at-will full-time position to serve as the department education information officer and the department may use this appropriation for necessary contractual expertise to implement this footnote.

(c)  The department shall report progress under this footnote to the joint appropriations committee and the joint education interim committee not later than November 1, 2009, enumerating student information system improvements, reconstruction efforts and district compliance with system requirements, together with detailed statements of expenditures of amounts appropriated under this footnote.

(d)  In addition to subsection (c) of this footnote and not later than November 1, 2009, the department shall report to the joint education interim committee on the application of modifications and improvements to the student information system in accordance with this footnote, to recalibration of the education resource block grant model under W.S. 21‑13‑309(t), the allocation and use study effort on education resources conducted under 2008 Wyoming Session Laws, Chapter 95, Section 801, and to other ongoing school finance issues under review by the committee.".

Section 345.

(a)  There is created the legislative economic stimulus account.  To the extent not prohibited by federal law, all funds received by the state from the federal government under the American Recovery and Reinvestment Act of 2009 shall be deposited into the account.

(b)  Except as provided in this section, all funds and all income generated on the funds in the account shall remain in the account until appropriated by the legislature.

(c)  Funds in the account are appropriated as follows:

(i)  Funds specified by the Act to be used for projects administered by the transportation commission or the department of transportation are hereby appropriated to the department to be expended by the transportation commission in the amount appropriated by the Act for the purposes specified by the Act;

(ii)  Funds specified by the Act to be distributed to a tribal entity are hereby appropriated to the state auditor in the amount appropriated by the Act to be distributed as provided by the Act;

(iii)  Funds specified by the Act to be used for Clean Water State Revolving Fund or Drinking Water State Revolving Fund projects to be approved by the State Loan and Investment Board and administered by the Office of State Lands and Investments are hereby appropriated to the Office of State Lands and Investments to be expended by the State Land and Investment Board in the amount appropriated by the Act for the purposes specified by the Act;

(iv)  As necessary to be allocated and expended by the Governor in an emergency to avoid compromising the state's eligibility for or access to funds under the Act.  In such event, the Governor shall promptly advise the joint appropriations committee and management council of any action taken under this subsection.

(d)  The governor shall promptly report to the joint appropriations committee and the management council all funds made available to the state under the Act, specifying the purposes for which funds are required to be expended under the Act and, if applicable, the date by which the funds must be expended, identifying those funds available for nonspecified purposes and making recommendations as the governor deems advisable for the appropriation and expenditure of funds under the Act, including any condition recommended to be imposed upon any expenditure.

(e)  Funds in the account not appropriated under subsection (c) of this section are subject to the following:

(i)  The joint appropriations committee shall review the governor's report and recommend to the presiding officer of each house of the legislature and the management council whether the legislature should convene in special session if the governor has not called for a special session;

(ii)  If the legislature does not schedule a special session within twenty-one (21) days after receipt of the governor's report or if the president of the senate and the speaker of the house advise the governor in writing that they do not intend to call a special session, there is hereby appropriated from the account to the state entity specified by the Act the amounts provided under the Act.  If no state entity is specified, the governor is authorized to determine the most appropriate state entity to fulfill the function, and the amount is hereby appropriated to the state auditor for distribution to the entity as designated by the governor.  All appropriations under this paragraph are subject to any conditions the governor recommended be imposed under the report submitted under subsection (d) of this section.

(f)  All expenditures made pursuant to subsection (c) or (e) of this section shall be reported through the B-11 process and shall not be included in any agency’s 2011-2012 standard biennial budget request.

(g)  As used in this section:

(i)  "Account" means the legislative economic stimulus account created by this section;

(ii) "Act" means the federal American Recovery and Reinvestment Act of 2009;

(iii)  "State" means the state of Wyoming or any of its branches, agencies, departments, boards, instrumentalities, separate operating units, or institutions.".
