Increase in salary payments to County and Prosecuting Attorneys, as well as District Attorneys.
Assumptions:
The most current year for which we have claim information is FY2008, during which the maximum payment per county under the statute cited above was $42,500 ($85,000 x 50%). The average actual claim for payment was $36,246. Effective January 1, 2009, the maximum allowable payment per county will increase to $47,250 ($94,500 x 50%). This proposed legislation further increases the maximum allowable payment per county to $50,000 ($100,000 x 50%) effective January 3, 2011.
If the counties increase compensation to the County and Prosecuting Attorneys to the maximum allowable as of January 2009, and then increase to the maximum allowable again as of January 2011, then the impact of this legislation is $57,750 per year. The amount indicated above represents the maximum cost scenario, assuming no salary increases between FY2008 and January of 2011, followed by an increase to the maximum allowable at that time. It is unlikely the counties would compensate their County and Prosecuting Attorneys in this manner, but we are unable to estimate the amount or timing of incremental increases between now and January 3, 2011.
