Summary/Major Elements:

· The act amends definitions within the statutory provisions allowing cooperate electric utilities to opt out of rate regulation.

· The act extends the opt out provisions to cooperative electric utilities organized under the laws of other states.

· The act applies the opt out provisions to any member owned cooperate engaged in the business of distributing energy related commodities and permits those cooperatives to opt out of rate regulation of any energy related commodity they sell.

· The act requires any cooperative that has opted out of rate regulation to apply energy retail rates equally to all member owners in the same rate class.  Failure to do so will immediately subject the cooperative to rate regulation.
