     Section 351.

 

(a)  There is appropriated one million dollars ($1,000,000.00) from the general fund to the department of health.  This appropriation shall be for the period ending June 30, 2012.   This appropriation shall only be expended for the purpose of funding grants under this section.  Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert as provided by law on June 30, 2012.

 

(b)  The department of health shall, by rule and regulation, administer a grant program to fund technologies at critical access or rural hospitals, as defined in W.S. 35‑1‑1002(a)(ii), to meet requirements to become meaningful users of electronic health records under the American Recovery and Reinvestment Act of 2009.  The department shall base criteria for grants under this section on the needs of hospitals to provide care and services and the needs of hospitals to meet the federal directive to convert to electronic health records.  No single grant under the program shall exceed four hundred thousand dollars ($400,000.00).".

(a)  The board of trustees in each school district shall:

 

(xxx) Adopt protocols to address risks associated with concussions and other head injuries resulting from athletic injuries.  The protocols shall:

 

(A) Include training of coaches and athletic trainers to facilitate the recognition of symptoms of concussions;

 

(B) Address restrictions concerning participation in school athletic events after suffering a concussion or head injury;

(c)  Phase one shall measure the core indicators specified under subsection (b) of this section by the statewide student assessment implemented under W.S. 21‑2‑304(a)(v) for school year 2011‑2012, inclusive of all students enrolled in a school on or before October 1, 2011.  Each score shall be aggregated to the school level based upon those grades served by each school as reported by the respective school district to the department.  The department shall separate reported schools into elementary, middle and high school levels, and shall adjust as necessary for different grade configurations.

 

(d)  Based upon school year 2008‑2009 statewide assessment scores for students performing at proficient and advanced proficient, as computed in accordance with paragraph (e)(i) of this section, the department shall establish the following cut scores for core indicator performance levels:

 

(i)  "Distinguished level of performance" equivalent to the lowest performing school within the highest twenty percent (20%) of schools within the state performing at proficient and advanced proficient on reading and math;

 

(ii)  "Sufficient level of performance" equivalent to those schools not meeting the top twenty percent (20%) performing at proficient or advanced proficient levels, but above the lowest twenty percent (20%) performing at proficient and advanced proficient levels on reading and math;

 

(iii)  "Focus level of performance" equivalent to the highest performing school of those schools within the bottom twenty percent (20%) performing at proficient and advanced proficient levels on reading and math.

 

(e)  Using the categories established under subsection (d) of this section, the department shall rank each school within the state using statewide assessment results in reading and mathematics for school year 2010‑2011, updated each school year thereafter and in accordance with the following:

 

(i)  Individual school scores shall be computed by dividing the sum of the total number of students within the school performing at proficient and advanced proficient in reading and the number performing at proficient and advanced proficient in mathematics, by the total number of students assessed for reading plus the total number assessed for mathematics within the school for the 2010‑2011 school year, and each school year thereafter.".
